July 27, 2004 0 6 7 <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br /> (a) The applicant shall provide a minimum of 24 parking spaces for the eating <br /> <br />place. <br /> <br />(b) The seating capacity of the eating place shall be limited to 75. <br /> <br /> (c) The hours of operation shall be from 7:00 a.m. to 4:00 p.m., Monday <br />through Saturday. <br /> <br /> (d) The applicant shall submit a site plan to the City Engineer showing <br />landscaping and parking spaces that meet parking standards. <br /> <br />(e) The storage/removal of trash shall be in accordance with the waste <br />management plan approved by the Department of General Services on May 20, 2004. <br /> <br /> (f) The applicant shall submit to all required inspections by the City's Fire <br />Prevention Bureau, the Public Health Department and the Building Official. This shall <br />include an initial inspection prior to the opening of the business and annual inspections <br />thereafter. <br /> <br /> (g) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br /> (h) All taxes and fees owed or collected in connection with the subject <br />property and operations shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Moody, Psimas, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />04 - 289 - Boards and Commissions <br /> <br />There were no appointments. <br /> <br />- New Business - <br /> <br />04 - 290 - Items Submitted by Council Members <br /> <br />Vice Mayor Moody informed the citizens that Councilman Heretick is attending the <br />Democratic Convention in Boston. <br /> <br />Councilman Whitehurst requested the City Manager to present information on <br />Festivals and Special Events to the public, August 24, 2004, at 7:00 p.m. for the <br />purposes of Channel 48 (under Report of Pending Items). <br /> <br />04 - 291 - Report on Pending Items <br /> <br />There were no pending items. <br /> <br />04 - 291 - Non-Agenda Speakers <br /> <br />Ned McCabe, 602 Rock Bridge Road, spoke on "Portsmouth Reads", advising <br />Council of the organization's interest in working with the legislature on childcare <br />initiatives for improving language and other learning skills. Also, he provided two <br />tapes for Channel 48 to be used for the benefit of parents. <br /> <br />2. J. Brewer Moore, 308 Bobby Jones Drive, spoke on living wills. <br /> <br /> <br />
