That the use permit is approved subject to the following conditions which the applicant and any successor in interest shall observe: (a) The applicant shall provide a minimum of 24 parking spaces for the eating place. (b) The seating capacity of the eating place shall be limited to 75. (c) The hours of operation shall be from 7:00 a.m. to 4:00 p.m., Monday through Saturday. (d) The applicant shall submit a site plan to the City Engineer showing landscaping and parking spaces that meet parking standards. (e) The storage/removal of trash shall be in accordance with the waste management plan approved by the Department of General Services on May 20, 2004. (f) The applicant shall submit to all required inspections by the City's Fire Prevention Bureau, the Public Health Department and the Building Official. This shall include an initial inspection prior to the opening of the business and annual inspections thereafter. (g) The applicant shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain all necessary licenses and permits. (h) All taxes and fees owed or collected in connection with the subject property and operations shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Councilman Whitehurst requested the City Manager to present information on Festivals and Special Events to the public, August 24, 2004, at 7:00 p.m. for the purposes of Channel 48 (under Report of Pending Items). 04 - 291 - Report on Pending Items There were no pending items. 04 - 291 - Non-Agenda Speakers Ned McCabe, 602 Rock Bridge Road, spoke on "Portsmouth Reads", advising Council of the organization's interest in working with the legislature on childcare initiatives for improving language and other learning skills. Also, he provided two tapes for Channel 48 to be used for the benefit of parents. 2. J. Brewer Moore, 308 Bobby Jones Drive, spoke on living wills.
