This shall <br />include an initial inspection prior to the opening of the business and annual inspections <br />thereafter. <br /> <br />(m) The applicant shall comply with the Statewide Building Code. <br /> <br /> (n) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br />(o) All taxes and fees associated with the operation shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions ma <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />04-274(c): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO ROBERT ANDERSON FOR Al <br />EATING PLACE AT 1805 COUNTY STREET. <br /> <br /> WHEREAS, Robert Anderson has made application pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit to operate an eating place at 1805 County Street; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia (1988) for the operation of an eating place al <br />1805 County Street, and being more particularly described as: <br /> <br />U P-04-15 <br /> <br /> Beginning at a point approximately 260' west of the southwest <br />corner of the intersection of County Street and Williamsburg Avenue; <br />thence in a southerly direction approximately 215' to a point; thence in a <br />westerly direction approximately 105' to a point; thence in a northerly <br />direction approximately 215' to a point; thence in a easterly direction <br />approximately 105' to a point at the beginning. <br /> <br /> <br />
