July 27, 2004 (I) The center shall submit to all required inspections by the City's Fire Department Bureau, the Public Health Department and the Building Official. This shall include an initial inspection prior to the opening of the business and annual inspections thereafter. (m) The applicant shall comply with the Statewide Building Code. (n) The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments and shall obtain and maintain in effect all necessary licenses and permits. (o) All taxes and fees associated with the operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions ma serve as grounds for revocation of the use permit by the City Council." 04-274(c): "A RESOLUTION GRANTING A USE PERMIT TO ROBERT ANDERSON FOR Al EATING PLACE AT 1805 COUNTY STREET. WHEREAS, Robert Anderson has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate an eating place at 1805 County Street; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of an eating place al 1805 County Street, and being more particularly described as: U P-04-15 Beginning at a point approximately 260' west of the southwest corner of the intersection of County Street and Williamsburg Avenue; thence in a southerly direction approximately 215' to a point; thence in a westerly direction approximately 105' to a point; thence in a northerly direction approximately 215' to a point; thence in a easterly direction approximately 105' to a point at the beginning.
