Motion by Mr. Pitts, and seconded by Mr. Benn, to adopt the following resolution, approved on first reading at the October 28, 2003 meeting, with the additional conditions, the facility shall be operated solely as a banquet facility for private parties, no part of the facility may be used at any time to accommodate the excess restaurant patrons of the existing Clayten's restaurant located at 1805 Hedges Ferry Road, banquets will not exceed 8 per month and no food preparation equipment on site, and was adopted by the following vote: 03-372(b): "A RESOLUTION GRANTING A USE PERMIT FOR A BANQUET FACILITY AT 1811 HODGES FERRY ROAD. WHEREAS, Alma F. Flenner, by her attorney, J. Wayne Sprinkle, has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit operate banquet facility at 1811 Hedges Ferry Road; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the City Council has considered the Planning Commission's recommendation of denial of the use permit and the City Manager's recommendation of approval of the use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a banquet facility at 1811 Hedges Ferry Road, and being more particularly described as:
