November 25, 2003 UP-03-17 Beginning at a point approximately 315' north of the intersection of Airline Boulevard and Hodges Ferry Road; thence in a easterly direction approximately 194' to a point; thence in a northwesterly direction approximately 217' to a point: thence in a southerly direction approximately 104' to a point of the beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Capacity of the facility shall be limited to no more than 48 seats. (b) 10:30 p.m., Saturday. The hours of operation shall be limited to the hours of 12:00 noon and Sunday through Thursday, and 12:00 noon until 5:00 p.m., Friday and (c) use. A minimum of twelve on-site parking spaces shall be provided for patron (d) All taxes and fees owed or collected in connection with the subject property and operations shall be paid when due. A copy of this letter shall be provided to the Director of Planning and Zoning. If, within six months of the date of this letter, said Director, in his discretion, determines that offenses against peace and good order are continuing, then he may initiate proceedings for the revocation of this permit. Provided, however, that if problems of peace and good order are of such severity that the Chief of Police determines that there is significant risk of blight, then revocation proceedings may be initiated by the Director without regard to the six-month requirement that is otherwise required. (g) The applicant and all successors in interest must comply with the trash storage and disposal plan approved by the Director of General Services on July 18, 2003. (h) The applicant and any successor in interest shall comply with all applicable codes, ordinances and regulations of federal, state and local governments and shall obtain and maintain all required licenses and permits. (i) The facility shall be operated solely as a banquet facility for private parties. (j) No part of the banquet facility shall be used at any time to accommodate the excess restaurant patrons of the existing Clayton's Restaurant located at 1805 Hodges Ferry Road. (k) The number of banquets shall not exceed eight per month. (I) No food preparation equipment shall be located on site.
