November 25, 2003 <br /> <br />UP-03-17 <br /> <br />Beginning at a point approximately 315' north of the <br />intersection of Airline Boulevard and Hodges Ferry Road; <br />thence in a easterly direction approximately 194' to a point; <br />thence in a northwesterly direction approximately 217' to a <br />point: thence in a southerly direction approximately 104' to a <br />point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Capacity of the facility shall be limited to no more than 48 seats. <br /> <br /> (b) <br />10:30 p.m., <br />Saturday. <br /> <br />The hours of operation shall be limited to the hours of 12:00 noon and <br />Sunday through Thursday, and 12:00 noon until 5:00 p.m., Friday and <br /> <br /> (c) <br />use. <br /> <br />A minimum of twelve on-site parking spaces shall be provided for patron <br /> <br /> (d) All taxes and fees owed or collected in connection with the subject <br />property and operations shall be paid when due. <br /> <br /> (e) <br />premises. <br /> <br />No live entertainment or amplified music shall be permitted on the <br /> <br /> (f) The applicant shall not violate any laws of the Commonwealth or <br />ordinances of the City related to peace and good order, nor suffer repeated or chronic <br />violations by any of its patrons or customers. If the Chief of Police, in his discretion, <br />determines that there are sufficient violations of this type to comprise a significant law <br />enforcement problem, then he shall so notify the applicant in writing and shall offer to <br />meet to provide advice on how to lessen and avoid repeated offenses against peace <br />and good order. A copy of this letter shall be provided to the Director of Planning and <br />Zoning. If, within six months of the date of this letter, said Director, in his discretion, <br />determines that offenses against peace and good order are continuing, then he may <br />initiate proceedings for the revocation of this permit. Provided, however, that if <br />problems of peace and good order are of such severity that the Chief of Police <br />determines that there is significant risk of blight, then revocation proceedings may be <br />initiated by the Director without regard to the six-month requirement that is otherwise <br />required. <br /> <br /> (g) The applicant and all successors in interest must comply with the trash <br />storage and disposal plan approved by the Director of General Services on July 18, <br />2003. <br /> <br /> (h) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances and regulations of federal, state and local governments <br />and shall obtain and maintain all required licenses and permits. <br /> <br />(i) The facility shall be operated solely as a banquet facility for private parties. <br /> <br /> (j) No part of the banquet facility shall be used at any time to accommodate <br />the excess restaurant patrons of the existing Clayton's Restaurant located at 1805 <br />Hodges Ferry Road. <br /> <br />(k) The number of banquets shall not exceed eight per month. <br /> <br />(I) No food preparation equipment shall be located on site. <br /> <br /> <br />
