The motion was withdrawn. <br /> <br /> Motion by Mr. Griffin, and seconded by Ms. Randall, to defer consideration of <br />UP-03-17 to the meeting of October 28, 2003, and was adopted by unanimous vote. <br /> <br />(c) UP-03-23 <br /> <br />DOWNTOWN CORRIDOR Dale Kelly, on behalf of C & K <br />Transport, Inc. requests a use permit for a trucking company at 800 <br />Constitution Avenue. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Benn, to concur with the <br />recommendation of the Planning Commission that UP-03-23 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />- City Manager's Report - <br /> <br />03 - 373 - Adoption of an ordinance to repeal Section 25-98 of the City Code prohibiting <br />the taking of photographs or the making of films in city parks for commercial purposes <br />without a permit. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to repeal Section 25-98 of the City Code prohibiting the <br />taking of photographs or the making of films in city parks for commercial purposes <br />without a permit. <br /> <br />Purpose and Need: <br /> <br />· The current ordinance prohibiting commercial photography or filming in city parks <br />without a permit was adopted prior to 1973. <br /> <br />· The Department of Community Relations and Leisure Services has determined that <br />a criminal penalty is unnecessary, and that such activities can be regulated <br />administratively. <br /> <br />· Repeal of the ordinance will eliminate the criminal sanction. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact. <br /> <br /> <br />
