October 14, 2003 Motion by Mr. Griffin, and seconded by Mr. Benn, to concur with the recommendation of the Planning Commission that Z-03-08 be approved on first reading, and was adopted by a vote of 5-1 (Randall). (b) UP-03-17 HODGES FERRY NEIGHBORHOOD - J. Wayne Sprinkle, representing Alma F. Flenner, requests a use permit to operate a banquet facility for Clayton's Restaurant at 1811 Hodges Ferry Road. 1. Wayne Sprinkle, 355 Crawford Street, Suite 812, spoke in support of this item. 2. Anna Hayden, 810 Nottingham Road, spoke in opposition to this item. 3. (c) UP-03-23 DOWNTOWN CORRIDOR Dale Kelly, on behalf of C & K Transport, Inc. requests a use permit for a trucking company at 800 Constitution Avenue. Motion by Mr. Pitts, and seconded by Mr. Benn, to concur with the recommendation of the Planning Commission that UP-03-23 be approved on first reading, and was adopted by unanimous vote. - City Manager's Report - 03 - 373 - Adoption of an ordinance to repeal Section 25-98 of the City Code prohibiting the taking of photographs or the making of films in city parks for commercial purposes without a permit. Recommendation: · Adoption of an ordinance to repeal Section 25-98 of the City Code prohibiting the taking of photographs or the making of films in city parks for commercial purposes without a permit. Purpose and Need: · The current ordinance prohibiting commercial photography or filming in city parks without a permit was adopted prior to 1973. · The Department of Community Relations and Leisure Services has determined that a criminal penalty is unnecessary, and that such activities can be regulated administratively. · Repeal of the ordinance will eliminate the criminal sanction. Financial Impact: · There is no financial impact.
