Au,qust 12, 2003 <br /> <br />Financial Impact: <br /> <br />· The Memorandum provides for the City, beginning in FY 2004-05, to contribute <br />$400,000 per year for five years for the construction of the facility and $500,000 per <br />year for the operation, maintenance, utilities and other similar expenses. <br /> <br />· The financial obligations do not commence until FY 2004-05 and will be included in <br />the City's annual operating budget. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />MEMORANDUM OF UNDERSTANDING CONCERNING THE VIRGINIA SPORTS <br />HALL OF FAME. <br /> <br /> WHEREAS, the Virginia Sports Hall of Fame has long been an organization that <br />recognizes and honors the achievements of numerous Virginia athletes and sports <br />figures in many different sports; and <br /> <br /> WHEREAS, it has also contributed immeasurably to the quality of life of <br />Portsmouth, and to the recognition of Portsmouth throughout the Commonwealth of <br />Virginia and beyond; and <br /> <br /> WHEREAS, it is now embarking on an ambitious expansion that will allow the <br />public to more fully recognize the achievements of its honorees, and that will <br />complement even more fully the many attractions in our vibrant Olde Towne area; and <br /> <br /> WHEREAS, the funding for this expansion will be from many sources, including <br />the Commonwealth of Virginia and private individual and corporate donors; and it is <br />incumbent on the City of Portsmouth to bear its fair share of this financial responsibility; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the City Manager, acting by and on behalf of the City, is <br />authorized to execute the attached Memorandum of Understanding concerning the <br />Sports Hall of Fame, or one of substantially similar effect; and he is further authorized to <br />negotiate and to execute, on behalf of the City and after approval as to form and legality <br />by the City Attorney, such other and further legal instruments as may be needed to <br />effect the intent of the Memorandum of Understanding." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />03 - 271 - Public hearing on rezoning, use permit and group housing use permit <br />applications: <br /> <br />(a) Z-03-06 <br /> <br />ROLLINGWOOD NEIGHBORHOOD - Lonnie L. Parker requests a <br />rezoning of the property at 300 Cherokee Road from residential <br />multi-family, RM-75, to neighborhood commercial, C-l-K, to allow <br />for a childcare center. The Comprehensive Plan recommends <br />single family residential development. <br /> <br />1. James Martin, 200 High Street, spoke in support of this item. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Pitts, to concur with the <br />recommendation of the Planning Commission that Z-03-06 be approved on first reading, <br />and was adopted by unanimous vote. <br /> <br />(b) UP-03-19 <br /> <br />DOWNTOWN NEIGHBORHOOD - Patrick Olds requests a use <br />permit for a Domino's Pizza at 1201 London Boulevard.
