July 22, 2003 <br /> <br />03 - 258 - Adoption of an ordinance to amend Chapter 12 of the Code of the City of <br />Portsmouth to require the Clerks of the District and Circuit Courts to charge a local <br />criminal justice training academy fee in addition to other fees required by law. <br /> <br />State code provides that a local ordinance must be enacted before assessing the <br />fee. The fee will be used to offset the costs of running and maintaining the <br />Portsmouth Sheriff's Training Academy. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend the Code of the City of Portsmouth allowing for <br />the collection of a portion of a court fee to offset costs associated with the Portsmouth <br />Sheriff's Training Academy. <br /> <br />Purpose and Need: <br /> <br />· The Portsmouth Sheriff's Office maintains and operates a criminal justice training <br />academy in order to certify Deputy Sheriff's as mandated by the Code of Virginia. <br /> <br />· A recent change in Virginia State Code (§9.1-106) allows for a locality to charge a <br />fee, not to exceed one dollar, for criminal and traffic offenses processed through courts <br />of law in the City of Portsmouth. <br /> <br />· The collection of this proposed $1 fee will be used to offset the costs of running and <br />maintaining the Portsmouth Sheriff's Training Academy. <br /> <br />· In accordance with the State Code a local ordinance must be enacted for the <br />assessment of the fee by the court. <br /> <br />· The fee can then be collected and placed in the City's General Fund. <br /> <br />Financial Impact: <br /> <br />· Based on analysis of the Virginia Supreme Court's report for 2002, Portsmouth <br />processed over 29,000 cases in which this fee would apply. <br /> <br />· Using the statistics provided, the City should see projected revenue of approximately <br />$29,000 a year. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE AMENDING CHAPTER 12 OF THE PORTSMOUTH CITY CODE, <br />ENTITLED "FINANCE" BY ADDING A NEW SECTION 12-122 THERETO TO <br />REQUIRE THE CLERKS OF THE DISTRICT AND CIRCUIT COURTS TO CHARGE A <br />LOCAL CRIMINAL JUSTICE TRAINING ACADEMY FEE IN ADDITION TO CERTAIN <br />OTHER FEES REQUIRED BY LAW." <br /> <br />Ayes: Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />03 - 259 - Adoption of a resolution requesting that the Virginia Department of <br />Transportation (VDOT) approve the design of the Victory Boulevard project from <br />Interstate 264 to Greenwood Drive, which is required to purchase right-of-way and <br />subsequent construction. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution requesting the Virginia Department of Transportation <br />(VDOT) to approve the design of the Victory Boulevard project from Interstate 264 to <br />Greenwood Drive, which is required to purchase rights-of-way and for subsequent <br />construction. <br /> <br /> <br />
