July 22, 2003 <br /> <br />Financial Impact: <br /> <br />· Based upon the most recent 12 months' work measures applicable to the issuance <br />of liens, judgments, DMV Stops, Debt Set-Off (SODC), etc. of 55,000 such actions, the <br />annual revenue will be favorably impacted by approximately $550,000. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTERS 1, 35, AND 38 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 35-2(d), 35-3(d), <br />AND 38-94(a) THEREOF, AND BY ADOPTING A NEW SECTION 1-14 PERTAINING <br />TO ADMINISTRATIVE COSTS FOR DELINQUENT TAXES AND CHARGES." <br /> <br />Ayes: Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />03 - 257 - Adoption of an ordinance to amend Chapter 11 of the Code of the City of <br />Portsmouth to standardize the requirements for erosion control plans. <br /> <br />This amendment will lower the threshold from 10,000 square feet of disturbed <br />area to 2,500 square feet. This will give the City more leverage for enforcing <br />erosion and sediment control regulations and is more in line with surrounding <br />localities. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Chapter 11 of the Portsmouth City Code to <br />standardize the requirements for erosion control plans. <br /> <br />Purpose and Need: <br /> <br />· There is a need to standardize the requirement for Erosion and Sediment Control <br />Plans at one "disturbed area" threshold at 2500 square feet. Currently, disturbed areas <br />outside of the Chesapeake Bay Preservation Area have a threshold of 10,000 square <br />feet. Also, single-family lots outside of a new subdivision are currently exempt from the <br />requirement. <br /> <br />· By lowering the threshold for all "disturbed areas" to 2,500 square feet and not <br />exempting lots outside of new subdivisions, the City will have more leverage <br />enforcing erosion and sediment control regulations. <br /> <br />for <br /> <br />· There is also a need to standardize the fees for a land-disturbing permit (LDP) to <br />$50. Currently, there is no charge for a LDP for single-family residential lots outside of <br />the CBPA, and single family lots often require as much administrative and inspection <br />effort as other types of development. <br /> <br />Financial Impact: <br /> <br />· At the current level of development, the increase in fees collected is projected to be <br />approximately $500 to $1,000 per month. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Pitts, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 11 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 11-3(10)AND (11) <br />AND 11-10(c)(1)THEREOF PERTAINING TO LAND DISTURBANCE PERMITS FOR <br />SINGLE FAMILY RESIDENTIAL LOTS." <br /> <br />Ayes: Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
