At a Regular Meeting there were present: June 24, 2003 of the City Council Mayor James W. Holley III, Vice Mayor Bernard J. Thomas Benn III, Charles B. Whitehurst, Sr., Douglas Smith, City Attorney G. Timothy Oksman. Councilman Cameron C. Pitts opened the followed by the Pledge of Allegiance to the Flag. on Tuesday, June 24, 2003, D. Randall, Deputy City meeting with prayer, which was · The City of Portsmouth salute the Churchland High School Concert Band. - Unfinished Business - 03-206- Rezoning and use permit: Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following ordinance, approved on first reading at the June 10, 2003 meeting, and was adopted by the following vote: 03-206(a): "ZONING AMENDMENT ORDINANCE Z-03-09." Ayes: Benn, Griffin, Pitts, Randall, Whitehurst, Holley Nays: None 03-206(b): Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following resolution, approved on first reading at the June 10, 2003 meeting, and was adopted by the following vote: "A RESOLUTION GRANTING A USE PERMIT FOR A WATER STORAGE AND PUMPING FACILITY AT 313 AND 321 CHOATE STREET. WHEREAS, the City of Portsmouth has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to construct and operate a water storage and pumping facility at 313 and 321 Choate Street; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; 03 -218 -Presentation: Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a Called Meeting on June 10, 2003, and a Regular Meeting on June 10, 2003, and was adopted by unanimous vote. Mayor Holley called the meeting to order and welcomed all in attendance.
