May 13, 2003 <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Moody, that item CA-03-02, dealing <br />with flea markets on City owned property, be amended and set for a second reading, <br />with the amendment to be as follows: The change to the zoning ordinance shall be <br />effective only through the date of our second September meeting. This item shall be <br />placed on our agenda for the meeting. The City Manager will make a report to Council <br />prior to the meeting, with his recommendations. His report and recommendations shall <br />be based on the City's actual experience with the flea market contemplated by this <br />ordinance change. Council may then vote to make the zoning change permanent. If <br />approved by Council at that time, it shall be permanent. If Council does not affirmatively <br />vote to make the change permanent, then it shall expire, and flea markets would no <br />longer be permitted in City owned property in this district, and was adopted by <br />unanimous vote. <br /> <br />- Unfinished Business - <br /> <br />03 - 151 (a) - Use permit: <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, approved on first reading at the April 22, 2003 meeting, and was adopted by <br />the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT FOR THE FABRICATION OF METAL <br />COMPONENTS FOR SHIPS AT A SITE IN THE PORTCENTRE COMMERCE PARK. <br /> <br /> WHEREAS, Premier Copper and Brass/Atlantic, Inc., has made application <br />pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for <br />the granting of a use permit to fabricate metal components for ships (SIC 3494 and <br />3498' in the PortCentre Commerce Park in Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code <br />of the City of Portsmouth, Virginia (1988) for the fabrication of metal components for <br />ships on property located in the PortCentre Commerce Park, Portsmouth, Virginia, and <br />being more particularly described as: <br /> <br /> <br />
