May 13, 2003 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, May 13, 2003, <br />there were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. <br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br /> Dr. L. Wilbur Kersey, Pastor of Court Street Baptist Church opened the meeting <br />with prayer, which was followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a <br />Called Meeting on April 22, 2003, and a Regular Meeting on April 22, 2003, and was <br />adopted by unanimous vote. <br /> <br />03 - 168 - Presentations: <br /> <br />· Proclamation presented to Peg Nourie for"National Safe Boating Week". <br /> <br />· Presentation of a Key to the City to Rashidra Lennell Scott, "Miss Portsmouth <br /> Seawall". <br /> <br />· Presentation of a Key to the City to Morgan Leigh Phelps, "Little Miss Portsmouth <br /> 2003". <br /> <br />· Presentation of special lapel pins to newly appointed Board and Commission <br /> members. <br /> <br />- Public Hearing - <br /> <br />03 - 169 - Public hearing on rezoning and code amendment applications: <br /> <br />(a) Z-03-04 <br /> <br />BRIGHTON NEIGHBORHOOD - Mount Sinai Church requests <br />rezoning of 2700 Chestnut Street from Commercial C-2-K <br />(Conditional) to Commercial C-2-K (Conditional) to remove the <br />"parking only" condition on the property. The Comprehensive Plan <br />recommends residential use. <br /> <br />1. William Verebely, 2200 Dunbarton Drive, Chesapeake, spoke in support of this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Ms. Randall, to concur with the <br />recommendation of the Planning Commission that Z-03-04 be approved on first reading, <br />and was adopted by unanimous vote. <br /> <br />(b) Z-03-11 <br /> <br />RIVER POINTE NEIGHBORHOOD - Frank R. Spadea requests to <br />modify the conditional rezoning at 3801 River Pointe Parkway. The <br />property is zoned and will remain RM-75-K. The Comprehensive <br />Plan recommends commercial development. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that Z-03-11 be approved on first reading, <br />and was adopted by unanimous vote. <br /> <br />(c) CA-03-02 <br /> <br />DOWNTOWN NEIGHBORHOOD - Code Amendment to Section <br />40-43.4 (66) to allow flea markets on city owned or controlled <br />property in the D-1 zoning districts. <br /> <br />1. Michelle Weiss, President, Olde Towne Civic League, spoke in support of this item. <br /> <br />2. Yvonne Lerner, 610 High Street, spoke in support of this item. <br /> <br />3. Anne Davis, 101 Crawford Parkway, spoke in support of this item. <br /> <br /> <br />
