May 13, 2003 At a Regular Meeting of the City Council on Tuesday, May 13, 2003, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. Dr. L. Wilbur Kersey, Pastor of Court Street Baptist Church opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a Called Meeting on April 22, 2003, and a Regular Meeting on April 22, 2003, and was adopted by unanimous vote. 03 - 168 - Presentations: · Proclamation presented to Peg Nourie for"National Safe Boating Week". · Presentation of a Key to the City to Rashidra Lennell Scott, "Miss Portsmouth Seawall". · Presentation of a Key to the City to Morgan Leigh Phelps, "Little Miss Portsmouth 2003". · Presentation of special lapel pins to newly appointed Board and Commission members. - Public Hearing - 03 - 169 - Public hearing on rezoning and code amendment applications: (a) Z-03-04 BRIGHTON NEIGHBORHOOD - Mount Sinai Church requests rezoning of 2700 Chestnut Street from Commercial C-2-K (Conditional) to Commercial C-2-K (Conditional) to remove the "parking only" condition on the property. The Comprehensive Plan recommends residential use. 1. William Verebely, 2200 Dunbarton Drive, Chesapeake, spoke in support of this item. Motion by Mr. Whitehurst, and seconded by Ms. Randall, to concur with the recommendation of the Planning Commission that Z-03-04 be approved on first reading, and was adopted by unanimous vote. (b) Z-03-11 RIVER POINTE NEIGHBORHOOD - Frank R. Spadea requests to modify the conditional rezoning at 3801 River Pointe Parkway. The property is zoned and will remain RM-75-K. The Comprehensive Plan recommends commercial development. Motion by Mr. Benn, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that Z-03-11 be approved on first reading, and was adopted by unanimous vote. (c) CA-03-02 DOWNTOWN NEIGHBORHOOD - Code Amendment to Section 40-43.4 (66) to allow flea markets on city owned or controlled property in the D-1 zoning districts. 1. Michelle Weiss, President, Olde Towne Civic League, spoke in support of this item. 2. Yvonne Lerner, 610 High Street, spoke in support of this item. 3. Anne Davis, 101 Crawford Parkway, spoke in support of this item.
