March 25, 2003 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, March 25, 2003, <br />there were present: <br /> <br />Mayor James W. Holley III, *Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. <br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br /> Councilman Cameron C. Pitts opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a <br />Called Meeting on March 11, 2003, and a Regular Meeting on March 11, 2003, and was <br />adopted by unanimous vote. <br /> <br />03 - 103 - Presentations: <br /> <br />· Proclamation presented to Robert Simmons for "National Victim's Right Week." <br /> <br />· Proclamation presented to Delores Adams for "Fair Housing Month." <br /> <br />- Public Hearing - <br /> <br />03 - 104 - Joint public hearing with the Portsmouth Redevelopment and Housing <br />Authority to consider proposed Plan Amendments to the 2004 Community Development <br />Action Plan and proposed Amendments: Number 34 to the Crawford Urban Renewal <br />Plan. <br /> <br />1. Malcolm Fortson, 524 Crawford Place, spoke in support of the amendment with <br />modifications for the homeless. <br /> <br />- Unfinished Business - <br /> <br />03 - 85 - Use permits: <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, approved on first reading at the March 11, 2003 meeting, and was adopted <br />by the following vote: <br /> <br />03-85(a): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO PULL-A-PART OF PORTSMOUTH, <br />L.L.C., FOR A MOTOR VEHICLE RECYCLING FACILITY AT 3850 ELM AVENUE. <br /> <br /> WHEREAS, Pull-a-Part of Portsmouth. L.L.C., has made application pursuant <br />to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting <br />of a use permit for the operation of a motor vehicle recycling facility at 3850 Elm <br />Avenue, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> <br />
