February 25, 2003 <br /> <br />(c) S-03-03 <br /> <br />PORT CENTRE NEIGHBORHOOD Ordinance granting the <br />request of the Industrial Development Authority for the closure of a <br />portion of Nelson Street (between 5th and 6th Street) within the Port <br />Centre Commerce Park. The Comprehensive Plan recommends <br />industrial development. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE CLOSING AND VACATING A PORTION OF NELSON STREET." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />Consent Aqenda <br /> <br />03 - 44 - Use permits and group housing: <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following <br />resolutions, approved on first reading at the February 11, 2003 meeting, and was <br />adopted by the following vote: <br /> <br />03-44(a): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO INTEGRATED LIVING <br />COMMUNITIES OF PORTSMOUTH, L.L.C., TO OPERATE AN ADULT RESIDENTIAL <br />CARE FACILITY AT 4916 WEST NORFOLK ROAD. <br /> <br /> WHEREAS, a use permit to operate a group home for sixty adults on the subject <br />property was granted on July 28, 1987; and <br /> <br /> WHEREAS, an amendment to said use permit was approved by City Council on <br />October 25, 1995, expanded to 72 the permitted number of residents in said adult <br />residential care facility, but that the expansion never occurred; and <br /> <br /> WHEREAS, applicant Integrated Living Communities of Portsmouth, L.L.C., has <br />applied for a use permit to operate an adult residential care facility (SIC 836) for a total <br />of 84 adults at 4916 West Norfolk Road, Portsmouth, Virginia, also referred to in the <br />aforementioned use permits as 3911 Cedar Lane, pursuant to Section 40-43.1 of the <br />Code of the City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> <br />
