February 25, 2003 <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Integrated Living Communities of Portsmouth, L.L.C., is hereby granted <br />a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) to operate an adult residential care facility at 4916 West Norfolk Road, <br />Portsmouth, Virginia, being more particularly described as: <br /> <br />UP-03-03 <br /> <br />Beginning at the southeast corner of the intersection of <br />Cedar Lane and the Norfolk, Franklin and Danville Railway <br />right-of-way; thence, south 125'_+ to a point; thence, north <br />136' + to a point; thence, west 180' + to a point; thence, in a <br />southwesterly direction 49' + to the point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which shall <br />be observed by the applicant and any successor in interest: <br /> <br /> (a) The occupancy of the facility shall be limited to no more than eighty-four <br />(84) residents, aged 55 or older, and to required staff members. <br /> <br /> (b) The facility shall obtain an inspection by the Fire Prevention Bureau, <br />the Public Health Department and the Building Official and shall correct any noted <br />deficiencies immediately. <br /> <br /> (c) The project shall be developed in accordance with the submitted site <br />plan and floor plan identified as Exhibits A and B, attached hereto and made a part <br />hereof. <br /> <br /> (d) The facility shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments, and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br /> (¢) The applicant shall develop a Group 1 landscaping buffer between the site <br />and the adjacent railroad right-of-way to the west. <br /> <br /> (t') All taxes, in connection with the property and the proposed operation <br />shall be paid when due. <br /> <br /> (g) The City shall have the right to inspect the facility to ensure all conditions <br />of this use permit are being met. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />03-44(b): <br /> <br />"A RESOLUTION AMENDING A USE PERMIT GRANTED TO GROVE BAPTIST <br />CHURCH TO OPERATE A RELIGIOUS FACILITY BASED CHILD CARE CENTER AT <br />6006 CHURCHLAND BOULEVARD. <br /> <br /> WHEREAS, Grove Baptist Church was granted a use permit on November 27, <br />2001, pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) <br />for the operation of a religious facility based child care center (S.I.C. 835) at 6006 <br />Churchland Boulevard, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant now desires an amendment to that use permit to <br />expand the capacity of the facility, now designated as the Dr. M. O. Marriner Christian <br />Academy, to 67 children; and <br /> <br /> <br />
