January 14, 2003 <br /> <br /> (k) The center shall be operated in compliance with all applicable <br />codes, ordinances and regulations of federal, state and local governments, and all <br />required licenses and permits shall be obtained and maintained in effect. <br /> <br /> (I) Taxes and fees collected or associated with the property and the <br />operation shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />02-392(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A <br />CHILDCARE CENTER AT 1504, 1506, AND 1520 HIGH STREET AND 1507 AND <br />1509 QUEEN STREET. <br /> <br /> WHEREAS, Sandra Pinnock has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to <br />operate a child care center (SIC 835) at 1504, 1506, and 1520 High Street and 1507 <br />and 1509 Queen Street, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code <br />of the City of Portsmouth, Virginia (1988) for the operation of a child care center on <br />property located at 1504, 1506, and 1520 High Street and 1507 and 1509 Queen Street, <br />and being more particularly described as: <br /> <br />UP-02-25 <br /> <br />Beginning at a point approximately 132' from the northeast <br />corner of the intersection of High Street and Peninsula <br />Avenue; thence in a northerly direction approximately 230' to <br />a point' thence in a easterly direction approximately 240' to a <br />point; thence in a southerly direction approximately 230' to a <br />point; thence in a westerly direction approximately 240' to <br />the point <br />of beginning. <br /> <br /> <br />
