January 14, 2003 (k) The center shall be operated in compliance with all applicable codes, ordinances and regulations of federal, state and local governments, and all required licenses and permits shall be obtained and maintained in effect. (I) Taxes and fees collected or associated with the property and the operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 02-392(b): "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A CHILDCARE CENTER AT 1504, 1506, AND 1520 HIGH STREET AND 1507 AND 1509 QUEEN STREET. WHEREAS, Sandra Pinnock has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child care center (SIC 835) at 1504, 1506, and 1520 High Street and 1507 and 1509 Queen Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child care center on property located at 1504, 1506, and 1520 High Street and 1507 and 1509 Queen Street, and being more particularly described as: UP-02-25 Beginning at a point approximately 132' from the northeast corner of the intersection of High Street and Peninsula Avenue; thence in a northerly direction approximately 230' to a point' thence in a easterly direction approximately 240' to a point; thence in a southerly direction approximately 230' to a point; thence in a westerly direction approximately 240' to the point of beginning.
