January 14, 2003 <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br /> (a) <br />one time. <br /> <br />Occupancy of the childcare center shall not exceed 149 children at any <br /> <br /> (b) <br />age. <br /> <br />The age range of the children shall be from infants to twelve (12) years of <br /> <br /> (c) Indoor hours of operation shall be limited to the hours between 6:00 a.m. <br />to 11:30 p.m., Monday through Friday. <br /> <br /> (d) Outdoor play hours shall be limited to the hours between 8:00 a.m. and <br />6:00 p.m., Monday through Friday. <br /> <br /> (e) <br />time. <br /> <br />A maximum of 45 children shall occupy the outdoor play area at any one <br /> <br /> (f) The outdoor play area shall be enclosed with privacy fencing that is, at <br />least, four (4) feet in height. <br /> <br /> (g) A minimum of 28 off-street parking spaces shall be provided and <br />maintained for the child care center. <br /> <br />(h) No on-street parking for drop off/pick up of children shall be permitted. <br /> <br /> (i) The center shall be operated in compliance with the submitted floor plan <br />and a City-approved site plan showing all landscaping, parking, and outdoor play area <br />prior to occupancy. <br /> <br /> (j) Trash disposal shall be in accordance with an approved plan to store, <br />handle and remove trash/garbage on-site. <br /> <br /> (k) The center shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official. This shall include an <br />initial inspection prior to the opening of the business and annual inspections thereafter. <br /> <br /> (I) The center shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state and local governments, and all necessary <br />licenses and permits shall be obtained and maintained in effect. <br /> <br /> (m) All taxes and fees owed or collected in connection with the subject <br />property and operations shall be paid when due. <br /> <br /> (n) Any exterior alterations to the building must be approved through the <br />Downtown Design Committee. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />02 - 392 - Comprehensive plan and rezoning: <br /> <br />1. Kirby Stiening, 19 River Reach Close, spoke in support of these items. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Moody, to adopt the following <br />resolution and ordinance, approved on first reading at the December 10, 2002 meeting, <br />and was adopted by the following vote: <br /> <br /> <br />
