January 14, 2003 <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility <br />with surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for <br />parking, driveways, and curb cuts which will provide for safe and convenient traffic <br /> movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth <br />Zoning Ordinance. <br /> <br /> 2. That a use permit is hereby granted pursuant to Section 40-43.1 of the Code <br />of the City of Portsmouth, Virginia (1988) for the operation of a child care center on <br />property located at 46 Beechdale Road, and being more particularly described as: <br /> <br />UP-02-24 <br /> <br />Beginning at a point approximately 30'_+ from the northwest <br />corner of the intersection of Beechdale Road and <br />Beechwood Court; thence in a northeasterly direction <br />181.02'_+ to a point; thence, in a northwesterly direction <br />343.52'_+ to a point; thence, in a westerly direction 163.77'_+ <br />to a point; thence, in a southerly direction 267.96'_+ to a <br />point; thence, in a southeasterly direction 70'_+ to a point; <br />thence, in a southeasterly direction 133.90'_+ to a point; <br />thence, in a northeasterly direction 181.02'_+ to a point of the <br />beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br /> (a) Occupancy of the childcare center shall be limited to no more than <br />sixty-seven (67) children at any one time. <br /> <br />(b) Indoor hours of operation shall be limited to 6:00 a.m. to 6:00 p.m. <br /> <br /> (c) Outdoor play hours shall be limited to the hours between 8:00 a.m. <br />to 6:00 p.m. <br /> <br /> (d) A one-acre outdoor play area enclosed by a seven-foot high fence <br />shall be maintained. <br /> <br /> (e) A minimum of nine (9) off-street parking spaces shall be provided <br />for the childcare center. <br /> <br /> (f) The center shall constructed and operated in accordance with the <br />submitted site plan and floor plan. <br /> <br /> (g) The center shall be constructed and maintained in accordance with <br />the submitted landscaping plan entitled 'Plan of Proposed Play Area', dated October 21, <br />2002. <br /> <br /> (h) Disposal of trash generated by the center shall be in accordance <br />with the approved plan for the storage, handling and removal of trash on the site, <br />approved by the Director of General Services on October 17, 2002. <br /> <br /> (i) The operators of the center shall maintain an easement for the <br />City's existing 10" force main on the property. <br /> <br /> (j) The center shall submit to all required inspections by the City's Fire <br />Department Bureau, Public Health Department and Building Official. This shall include <br />an initial inspection prior to the opening of the business and annual inspections <br />thereafter. <br /> <br /> <br />
