January 14, 2003 <br /> <br />(c) UP-02-29 <br /> <br />PORT NORFOLK NEIGHBORHOOD - Nathaniel Thomas requests <br />a use permit to operate a motor vehicle/used parts junkyard at <br />718-720 Virginia Avenue. The property is zoned industrial M-2. <br />The Comprehensive Plan recommends industrial development. <br /> <br />1. Hollimon Gregg, III, 1045 Water Road, Chesapeake, spoke in support of this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by <br />recommendation of the Planning Commission that <br />reading, and was adopted by unanimous vote. <br /> <br />Mr. Moody, to concur with the <br />UP-02-29 be approved on first <br /> <br />(d) UP-03-02 <br /> <br />DOWNTOWN NEIGHBORHOOD -Wen Kong Ni requests a use <br />permit to operate an eating establishment at 1106 London <br />Boulevard. The property is zoned downtown D-2 mixed-use. The <br />Comprehensive Plan recommends commercial use. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that UP-03-02 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />(e) CA-02-06 <br /> <br />CITYWIDE - City of Portsmouth to amend Section 40-183 of the <br />Zoning Ordinance (crime penalties) to change fines from a <br />minimum of ten dollars ($10) to not more than two hundred fifty <br />dollars ($250); to a minimum of ten dollars ($10) to not more than <br />one thousand dollars ($1,000). The purpose is to be reflective of <br />the State Code. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that CA-02-06 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />- Unfinished Business - <br /> <br />02 - 392 - Use permits: <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Pitts, to adopt the following <br />resolutions, approved on first reading at the December 10, 2002 meeting, and was <br />adopted by the following vote: <br /> <br />02-392(a): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A <br />CHILDCARE CENTER AT 46 BEECHDALE ROAD. <br /> <br /> WHEREAS, Penny Williford has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to <br />operate a child care center (SIC 835) at 46 Beechdale Road, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended granting the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing <br />or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property <br />or improvements in the neighborhood; <br /> <br /> <br />
