January 14, 2003 (c) UP-02-29 PORT NORFOLK NEIGHBORHOOD - Nathaniel Thomas requests a use permit to operate a motor vehicle/used parts junkyard at 718-720 Virginia Avenue. The property is zoned industrial M-2. The Comprehensive Plan recommends industrial development. 1. Hollimon Gregg, III, 1045 Water Road, Chesapeake, spoke in support of this item. Motion by Mr. Whitehurst, and seconded by recommendation of the Planning Commission that reading, and was adopted by unanimous vote. Mr. Moody, to concur with the UP-02-29 be approved on first (d) UP-03-02 DOWNTOWN NEIGHBORHOOD -Wen Kong Ni requests a use permit to operate an eating establishment at 1106 London Boulevard. The property is zoned downtown D-2 mixed-use. The Comprehensive Plan recommends commercial use. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that UP-03-02 be approved on first reading, and was adopted by unanimous vote. (e) CA-02-06 CITYWIDE - City of Portsmouth to amend Section 40-183 of the Zoning Ordinance (crime penalties) to change fines from a minimum of ten dollars ($10) to not more than two hundred fifty dollars ($250); to a minimum of ten dollars ($10) to not more than one thousand dollars ($1,000). The purpose is to be reflective of the State Code. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that CA-02-06 be approved on first reading, and was adopted by unanimous vote. - Unfinished Business - 02 - 392 - Use permits: Motion by Mr. Moody, and seconded by Mr. Pitts, to adopt the following resolutions, approved on first reading at the December 10, 2002 meeting, and was adopted by the following vote: 02-392(a): "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A CHILDCARE CENTER AT 46 BEECHDALE ROAD. WHEREAS, Penny Williford has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child care center (SIC 835) at 46 Beechdale Road, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended granting the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood;
