353 A~ril 26, 1994 1. That the use for which the use permit hereinafter described is sought= (a) Will not adversely affect the health and persons residing or working in the neighborhood of use~ safety of the proposed (b) Will not be detrimental to the public use or injurious to the property or improvements in the neigb-borhood~ (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses~ (d) Will be a project that will be developed according to plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement~ and (e) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. That the STOP Organization is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate a child day care services facility at 2874 High Street, said property being a 10,746+ square foot parcel of a larger property known as 2874 High- Street, as shown on Exhibit A, attached hereto and made a part hereof. 3. That the use permit is approved subject to the following conditions: (a) This use permit is issued to the STOP Organization only and is not transferable. (b) No more than twenty (20) children shall be enrolled in the day care program. (c) The children enrolled shall be between three and five years of age. (d) All indoor activities shall be conducted between the hours of 8:00 A.M. and 6:00 P.M. (e) All outdoor play activities shall be conducted between the hours of 8:00 A.M. and 6:00 P.M. (f) The applicant must fully enclose the outdoor play area with a chain link fence at least four feet in height, and said fence shall be maintained in good condition by the applicant at all times. (g) The facility shall be inspected annually by the City Fire Department, and the City and State Health Departments. (h) The applicant shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments, and shall obtain all necessary licenses and permits."
