That the use for which the use permit hereinafter <br />described is sought= <br /> <br /> (a) Will not adversely affect the health and <br />persons residing or working in the neighborhood of <br />use~ <br /> <br />safety of <br />the proposed <br /> <br /> (b) Will not be detrimental to the public use or injurious <br />to the property or improvements in the neigb-borhood~ <br /> <br /> (c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses~ <br /> <br /> (d) Will be a project that will be developed according to <br />plan for parking, driveways, and curb cuts which will provide <br />for safe and convenient traffic movement~ and <br /> <br /> (e) Will be in accordance with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. That the STOP Organization is hereby granted a use <br />permit pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) to operate a child day care services <br />facility at 2874 High Street, said property being a 10,746+ <br />square foot parcel of a larger property known as 2874 High- <br />Street, as shown on Exhibit A, attached hereto and made a part <br />hereof. <br /> <br /> 3. That the use permit is approved subject to the following <br />conditions: <br /> <br /> (a) This use permit is issued to the STOP Organization only <br />and is not transferable. <br /> <br /> (b) No more than twenty (20) children shall be enrolled in <br />the day care program. <br /> <br /> (c) The children enrolled shall be between three and five <br />years of age. <br /> <br /> (d) All indoor activities shall be conducted between the <br />hours of 8:00 A.M. and 6:00 P.M. <br /> <br /> (e) All outdoor play activities shall be conducted between <br />the hours of 8:00 A.M. and 6:00 P.M. <br /> <br /> (f) The applicant must fully enclose the outdoor play area <br />with a chain link fence at least four feet in height, and said <br />fence shall be maintained in good condition by the applicant at <br />all times. <br /> <br /> (g) The facility shall be inspected annually by the City <br />Fire Department, and the City and State Health Departments. <br /> <br /> (h) The applicant shall comply with all applicable codes, <br />ordinances, and regulations of federal, state and local <br />governments, and shall obtain all necessary licenses and <br />permits." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />(c) Motion by Mr. King, and seconded by Mr. Epperson, the <br />following ordinance, approved on first reading at the Public <br />Hearing on April 11, 1994, was adopted and by the following <br />vote: <br /> <br /> "A/~ ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 33-32(A) <br />THEREOF PERTAINING TO SUBDIVISION UTILITY AND STREET <br />IMPROVEMENTS... <br /> <br /> <br />
