<br /> XV. All secondary distribution and transmission shall be solid grounded once in every 500 feet.
<br />
<br /> XV1. All electrical construction shall be in strict accordance with the several sections of
<br /> the National Code, covering the same.
<br />
<br /> XVll. The contractor shall agree that ~urlng the period of this contract or until any ¢ompet~
<br /> lng franchise is granted by the Oounoil, the s~id rates shall, every three years, be lowered, if
<br />
<br /> the average rates charged in other cities of the United States of the population of Portsmouth, or
<br /> then
<br /> less, at the time when computed, not using water power, shall he. found to be lower than the rates
<br />
<br /> above mentioned; and said average rates so found shall stay in effect for the succeeding period of
<br /> three years, or until the other termination of this agree~m~en~; but in no cas~ shall rates be'char-
<br /> ged which are higher than the rates above mentioned.
<br />
<br /> XVlll. The contras%or shall agree that electric current for lighting msnd power shall be a-
<br /> available to consumers at all times, night ~ud day, and the failure to provide such service shall
<br /> subject~ the contractor to a De~a!ty of $50 for each twenty-fourhours or part thereof, whichsh~ll
<br /> be paid to the City as liquidated damages, The contractor further agrees that he will furnish ~ree
<br /> renewals of !~mps to consumers upon request.

<br /> 2. Should anybld be accepted by the Oouncil and the franchise grauted then~at the termina-
<br />tion of said grant the plant as well as the proper~y, if any, of the grantee in the streets, ave-
<br />nues and other public places shall thereupon be and become the property ofthe City or. Portsmouth,
<br />should the City desire tc ack.ire the same, upon the payment of ~ fair valuation therefor. Should
<br />.the City and the grantee be unable to agree ~pon a fair valuation then such~val~ation is to be de-
<br />termined by thre~ disinterested persons, one selected by the Oity, one bmy the grantee, and the third
<br />by the two so selected.
<br />
<br /> 3. Should the bid accepted and the franchise gr~nted~be for the period of twenty years, then
<br /> at the termination of said contract, ten years from the ~ate th~ereof, the said franchise shall con-
<br /> tinue until the expiration of the grant upon the same terms and conditions as are herein above set
<br /> forth, save and except with reference to the lighting of the streets and public buildings of the.
<br /> Oity; but the Oity o~Portsmeuth reserves the right to rene~ the said ~ontraet at_the end of the
<br /> said first period of ten yes.rs at~ p~iees not exceeding those in effect ~t termination of said con-

<br /> 4. All bidders are to be invited to make their bids upon a ten year franch=se wmth ~ ten
<br /> yemr contract, and a twenty year franchise with a ten year contract; and each bidde=is required
<br /> to accompany his bid with a certified check payable to the City Treasurer in the sum of $5,000, to
<br /> be forfeited to the City as liquidated damages should he f~il tooomply with his bid and execute
<br /> the contract hereby required in the event of his bid beingm accepted and the franchise ,granted to him;
<br /> but should his bid be not accepted then the said check is to b~ returned to him.
<br />
<br /> 5- In the use of the streets, avenues an~ other public places, and in the conduct of his bu-
<br /> siness generally, the grantee shall, in all respects, comply with the ordinsmoes of the Oit~ now in
<br /> forc~ and to all amendments which may be thereto, from time to time made.
<br />
<br /> 6~ Should the grantee fail to comply with any of the terms and conditions of his grant, or of
<br />his contract, as herein required, and continue in such faiiuze for sixty days after written notice
<br />from the Oity, through the chairman of the Joint Zight Committee, requiring him to comply with the
<br />'same, then~the ~e, uncit of said City ma2 declare the said franchise and contract forfeited and may
<br /> ~mmedi! ~take charge of the plant ~nd othe~ ~roperty of the grantee in the streets, avenues and
<br /> other public places and maintain, control and operate the same.
<br />
<br /> 7- The grantee shall obligate himself to execute a bond in some Surety Compa~y,'which shall
