<br /> THIS INDENTURE OF LEASE, made this, the thirty-first day of March, A. D. nineteen hundred
<br />and nine, between The City of Por~mouth. acting by and through the 0ouncil of the said The City of
<br />Portsmouth, and the 0ounty of Norfolk, acting by and through the Board, of S~psrvisors of the said
<br />Oounty of Norfolk, pa=ties of the first part; and R. E. Jordan, of the City ofNOrfolk, in the State
<br />of Virginia, party of the second part.

<br /> WH~EAS, bv an act of the General Assembly of Virginia, as set forth and embodied in sec-
<br />tion one thousand three hundred ~ud seventy-one, of the Code of Virginia, edition eighteen hundred
<br />and eighty-seven, as amended by ~n act approved February 23d, 1898, the said Council and Board of
<br />Supervisors are authorized, if they deem best for the interest of said city and eo~ty, after adver-
<br />tising the same for thirty days previo~S-~to the d~y of the lease, to i~ase out the Ferries ~nich now
<br />ply, by'authority of law, between the cities of Portsmouth and Norfolk ~nd ~eltin~o~ Roint, or Berk-
<br />ley, k~nownas Norfolk Celerity Ferries, or any part thereof, at pubiie auction, to the highest bidder,
<br />for ~ term of ten years, at the expiration of which said term they may again lease the $~me, and con-
<br />tinne to lease the s~me, for terms not exceeding ten years each, upon such terms and conditions as
<br />the said Gouneil a~.d Board of Supervisors shall de,ermine, and may require bond or bonds from the les-
<br />see or lessees in such s-~ms as they may deem best for the faithful performance of the terms of the
<br />lease, and v~th securities deemed by them sufficient, ~nieh bond or bonds Shall be made payable to
<br />~I~ne City of 2ortsmouth and Norfolk County; provided, that said Go,moil and Board of S~pervisors may
<br />lease out the said Ferries as a ~nole or in such parts as they may deem best for the interest of the
