379 <br /> May 24, 1994 <br /> <br /> Attached for~your consideration, is an ordinance that will <br />amend the City Code to allow for such a transfer. In addition, <br />by separate vote, you would.need to adopt a motion signifying <br />your concurrence with Sheriff Waters' request to transfer his <br />Virginia Retirement System benefits and have same added to his <br />existing benefits in the Portsmouth Fire and Police Retirement <br />System." <br /> <br />The following spoke in opposition of the ordinance amendment: <br /> <br />Jackson Shaw, 503 Linda Road <br />Daniel Covey, 4516 Ibis Court <br />Robert Simmons, 6942 Kenny Lane <br />Lloyd Beazley, 3186 Reese Drive <br />David Beachler, 711 Crawford Parkway <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Hawks, to adopt <br />the following ordinance, and was adopted by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 30-151 <br />THEREOF, PERTAINING TO THE PORTSMOUTH FIRE AND POLICE RETIREMENT <br />SYSTEM." <br /> <br />Ayes: Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: Clemons <br /> <br /> Motion by Mr. Hawks, and seconded by Mr. King, to give the <br />concurrence of the local governing body and to permit the <br />transfer of Sheriff Gary Water's Virginia Retirement System <br />benefits and have same added to his existing benefits in the <br />Portsmouth Fire and Police Retirement System, effective on or <br />after July 1, 1994, was adopted, and by the following vote: <br /> <br />Ayes: Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: Clemons <br /> <br />94-186 - Letter from the City Manager recommending adoption of a <br />resolution appointing viewers for the closing of a portion of <br />Duchess Road, as bounded by Virginia Avenue and an alley lying <br />between Virginia Avenue and Chautauqua. <br /> <br /> "An application has been filed with the Planning Department <br />for the closure of that portion of Duchess Road, lying between <br />the west side of Virginia Avenue and the east side of an alley <br />140 feet west of Virginia Avenue. The Notice of Application and <br />Request for Appointment of Viewers has been advertised. <br /> <br /> I, therefore, recommend the adoption of a resolution <br />appointing viewers for this application... <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. King, to adopt the <br />following resolution, was adopted, and by the following vote: <br /> <br /> "A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A <br />PORTION OF DUCHESS ROAD, AS BOUNDED BY VIRGINIA AVENUE AND AN <br />ALLEY LYING BETWEEN VIRGINIA AVENUE AND CHAUTAUQUA AVENUE. <br /> <br /> WHEREAS, Guy W. Drake, Jr., and Jerre G. Ashberry, have <br />made application to vacate, close and discontinue the <br />hereinafter-described street, and it appearing that Notice of <br />Application and Request for Appointment of Viewers has been <br />advertised as required by law. <br /> <br /> <br />
