3?8 <br /> <br />May 24, 1994 <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Epperson, to <br />authorize the City Manager to exceed the 25% limit on change <br />orders to existing contracts, and was adopted by the following <br />vote: <br /> <br />Ayes: Clemons, Eppereon, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />94-184 Letter from the City Manager recommending adoption of <br />an ordinance to appropriate $20,000 from the Capital <br />Improvements Fund to complete design work for the new <br />Churchland Fire Station. <br /> <br /> "Funds are included in the 1993-98 Capital Improvement <br />Plan for the new Churchland Fire Station. In order to complete <br />the design work, the Director of Public Works recommends an <br />appropriation in the amount of $20,000 for this project. <br /> <br /> I concur with the Director of Public Works and, with your <br />approval of this item, the balance in the Capital Improvements <br />Funds is $11,493,116." <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Griffin, to <br />adopt the following ordinance, and was adopted by the following <br />vote: <br /> <br /> "AN ORDINANCE TO APPROPRIATE $40,000.00 FROM THE CAPITAL <br />IMPROVEMENTS FUND'FOR SIDEWALK AND CURB CONSTRUCTION." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />94-185 - Letter from the City Manager recommending adoption of <br />an ordinance to amend Chapter 30 of the Code of the City of <br />Portsmouth Virginia, 1988, by amending Section 30-151 thereof, <br />pertaining to the Portsmouth Fire and Police Retirement System. <br /> <br /> "On April 20, 1994, the Virginia General Assembly adopted <br />House Bill 9310. This bill allows a Constitutional Officer to <br />participate in local retirement systems, which the <br />Constitutional Officer had been a member of prior to his/her <br />election to a Constitutional Office. The bill becomes effective <br />on July 1, 1994~ <br /> <br /> Prior to his election as a Constitutional Officer, the <br />Sheriff of the City of Portsmouth had been a member of the <br />Portsmouth Police Department, and a member of the City's Fire <br />and Police Retirement System. Sheriff Waters accumulated more <br />than half (13 years, 9 months), of the total service credits <br />necessary to become eligible for full normal retirement <br />benefits, which is a requirement of the State law. <br /> <br /> This law would allow Sheriff Waters to withdraw the <br />eligible contributions which have been made since his election <br />to Constitutional Office from the Virginia Retirement System <br />and have same deposited into the City's Fire and Police <br />Retirement System. As you know, Sheriff Waters desires to <br />consolidate his retirement benefits from the Virginia <br />Retirement System into the Portsmouth Fire and Police <br />Retirement System. <br /> <br /> <br />
