(1988). by repealing Sections 16-91 through 16-160 <br />pertaining to garbage and refuse. <br /> <br /> "The Director of General Services, Mr. C, W. McCoy has <br />requested that Article III entitled "Privately Operated <br />Landfills" of Chapter 16, pertaining to garbage and refuse, be <br />repealed in its entirety. <br /> <br /> The repealing of Article III will preclude the possibility <br />of existence of privately operated landfills within the City of <br />Portsmouth. The Director of General Services believes that it <br />is in the best interest of the citizens of the City not to have <br />privately operated landfills and for the City to continue to <br />maintain its landfill at Craney Island. <br /> <br /> I respectfully request and recommend your approval of this <br />ordinance." <br /> <br /> Motion by Mr. King, and seconded by Mr. Hawks, to adopt the <br />following ordinance, and was adopted by the following vote: <br /> <br /> "AN ORDINANCE TO REPEAL ARTICLE III, ENTITLED "PRIVATELY <br />OPERATED LANDFILLS," OF CHAPTER 16 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY REPEALING SECTIONS 16-91 THROUGH <br />16-160 THEREOF, PERTAINING TO OARBAGE AND REFUSE.,. <br /> <br />Ayes: Clemons, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />94-215 - Letter from the City Manager regarding an ordinance to <br />amend Section 24-555 of the City's Noise Ordinance. <br /> <br /> "You have recently directed the staff to explore <br />modifications to the existing City Noise Ordinance. The City <br />Attorney has prepared an ordinance at your direction, which I <br />submit to you for your consideration." <br /> <br />Alan E. Gollihue, 216 North Street, spoke in opposition of the <br />proposed noise ordinance. <br /> <br /> Motion Mr. King, and seconded by Mr. Hawks, to adopt the <br />proposed ordinance. <br /> <br /> Amended motion by Mr. Clemons, and seconded by Mr. Pitts, <br />to remove Section 7 of the proposed ordinance, and was defeated <br />by a lack of a majority vote as indicated by the following vote: <br /> <br />Ayes: Clemons, Griffin, Pitts <br />Nays: Hawks, King, Webb <br /> <br /> Amended motion by Mr. Pitts, and seconded by Mr. Clemons, <br />to delete from the proposed ordinance all exemptions and day <br />time limits, and was defeated by the following vote: <br /> <br />Ayes: Clemons, Pitts <br />Nays: Griffin, Hawks, King, Webb <br /> <br /> Original motion by Mr. King, and seconded by Mr. Hawks, to <br />adopt the following ordinance, and was adopted by the following <br />vote: <br /> <br /> <br />
