June 28, 1994 from the Cit 'Manager recommending adoption of 94-245.- Letter y ~ an ordinance to amend Chapte9 24 of the Code of the City of Portsmouth, Virginia, pertaining to miscellaneous criminal offenses. "The 1994 General Assembly of Virginia enacted changes to the laws pertaining to miscellaneous criminal offenses. Since these requirements do not coincide with the requirements presently listed in our City Code, changes to Chapter 24 of the City Code are necessary. The proposed ordinance will amend provisions dealing with trespassing on school property, cursing and public intoxication. I hereby recommend your approval of this ordinance." Motion by Mr. Hawks, and seconded by Mr. King, to adopt the following ordinance, and was adopted by the following vote: "AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 24-208, 24-259 AND 24-317 (C), PERTAINING TO SWEARING, PUBLIC DRUNKENNESS AND TRESPASSING." Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb Nays: None 94-246 - Letter from the City Manager recommending adoption an ordinance to amend Chapter 36 of the Code of the City of Portsmouth, Virginia, pertaining to sidewalk vendors. of "As a result of the City Attorney's Office's continuous review of the provisions of the City Code, it has been determined that Section 36-3 needs to be amended to allow the sale of flowers, plants, trees and bulbs on City sidewalks by vendors where obtain sidewalk vendor permits under Chapter 32. I hereby recommend your approval of this ordinance." Motion by Mr. Hawks, and seconded by Mr. King, to adopt the following ordinance, and was adopted by the following vote: "AN ORDINANCE TO AMEND CHAPTER 36 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 36-3 THEREOF, PERTAINING TO THE SALE OF FLOWERS." Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb Nays: None 94-247 Letter from the City Manager recommending adoption of an ordinance to amend Section 38-94(a) of the Code of the City of Portsmouth, Virginia, pertaining to unpaid liens for water service charges. "Recent legislature provides that there is to be a lien on property for unpaid water service which is to have the same priority and be on a parity with liens for unpaid real estate taxes. The City Code currently provides that such llen is to be on a parity with unpaid taxes~ The addition of language declaring these liens is to be on a parity with unpaid "real estate" taxes will bring our Code into compliance with the State Code. I, therefore, recommend the adoption of this ordinance which will ensure the validity and priority of unpaid liens for water service charges." Motion by Mr. King, and seconded by Mr. Pitts, to adopt the following ordinance, and was adopted by the following vote:
