June 28, 1994 <br /> <br /> from the Cit 'Manager recommending adoption of <br />94-245.- Letter y ~ <br />an ordinance to amend Chapte9 24 of the Code of the City of <br />Portsmouth, Virginia, pertaining to miscellaneous criminal <br />offenses. <br /> <br /> "The 1994 General Assembly of Virginia enacted changes to <br />the laws pertaining to miscellaneous criminal offenses. Since <br />these requirements do not coincide with the requirements <br />presently listed in our City Code, changes to Chapter 24 of the <br />City Code are necessary. The proposed ordinance will amend <br />provisions dealing with trespassing on school property, cursing <br />and public intoxication. <br /> <br />I hereby recommend your approval of this ordinance." <br /> <br /> Motion by Mr. Hawks, and seconded by Mr. King, to adopt <br />the following ordinance, and was adopted by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 24-208, <br />24-259 AND 24-317 (C), PERTAINING TO SWEARING, PUBLIC <br />DRUNKENNESS AND TRESPASSING." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />94-246 - Letter from the City Manager recommending adoption <br />an ordinance to amend Chapter 36 of the Code of the City of <br />Portsmouth, Virginia, pertaining to sidewalk vendors. <br /> <br />of <br /> <br /> "As a result of the City Attorney's Office's continuous <br />review of the provisions of the City Code, it has been <br />determined that Section 36-3 needs to be amended to allow the <br />sale of flowers, plants, trees and bulbs on City sidewalks by <br />vendors where obtain sidewalk vendor permits under Chapter 32. <br /> <br />I hereby recommend your approval of this ordinance." <br /> <br /> Motion by Mr. Hawks, and seconded by Mr. King, to adopt <br />the following ordinance, and was adopted by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 36 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 36-3 <br />THEREOF, PERTAINING TO THE SALE OF FLOWERS." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />94-247 Letter from the City Manager recommending adoption of <br />an ordinance to amend Section 38-94(a) of the Code of the City <br />of Portsmouth, Virginia, pertaining to unpaid liens for water <br />service charges. <br /> <br /> "Recent legislature provides that there is to be a lien on <br />property for unpaid water service which is to have the same <br />priority and be on a parity with liens for unpaid real estate <br />taxes. The City Code currently provides that such llen is to <br />be on a parity with unpaid taxes~ The addition of language <br />declaring these liens is to be on a parity with unpaid "real <br />estate" taxes will bring our Code into compliance with the <br />State Code. <br /> <br /> I, therefore, recommend the adoption of this ordinance <br />which will ensure the validity and priority of unpaid liens for <br />water service charges." <br /> <br /> Motion by Mr. King, and seconded by Mr. Pitts, to adopt <br />the following ordinance, and was adopted by the following vote: <br /> <br /> <br />
