June 28, 1994 4 03 (d) Motion by Mr. Kin~i and ~' seconded by Mr. Clemons, to adopt the following resolution, and.was adopted by the following vote: "A RESOLUTION GRANTING A USE PERMIT TO CHAN LAI WAN FOR THE OPERATION OF A WHOLESALE DISTRIBUTION, LIGHT MANUFACTURING, ASSEMBLING AND TRADE CENTER LOCATED AT 3535 AIRLINE BOULEVARD. WHEREAS, Chan Lal Wan has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), for the granting of a use permit to operate a wholesale distribution, light manufacturing, assembling and trade center, located at 3535 Portsmouth Boulevard, Portsmouth, Virginia, as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and~ WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the hereinafter-described permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways and curb cuts which will provide for safe and convenient traffi= movement, and (e) Will be in accordance with the purpose of the City of Portsmouth Zoning Ordinance. 2. That Chan Lai Wan is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), for the operation of a wholesale distribution, light manufacturing, assembling and trade center, on property located at 3535 Airline Boulevard, and being more particularly described as: UP-94-8 Beginning on the south right-of-way line of Airline Boulevard a distance of 186.09 feet west from its intersection with Elmhurst Lane; thence continuing of 360 feet to a point; thence west 132.73 feet Greenwood Drive; thence feet to a point; thence southerly 170 feet to a west along Airline Boulevard a distance thence south 188.35 feet to a point; to the east right-of-way line of southerly along said right-of-way 681.95 east 151.40 feet to a point; thence point; thence southwest 14 feet to the north right-of-way line of Garwood Avenue; thence easterly along said right-of-way 566.03 feet to a point; thence northerly 135.73 feet to a point; thence easterly 111.03 feet to the west right-of-way line of Elmhurst Lane; thence northerly along said right-of-way 625.76 feet to a point; thence west 185.35 feet to a point; thence northerly 202.04 feet to the south right-of-way line of Airline Boulevard, the point of origin.
