<br />(C) (10) THEREOF, PERTAINING TO HEALS AT BED AND BREAKFAST INNS.

<br /> Motion by Mr. Clemons, and seconded by Mr. Pitts, to adopt
<br />the following resolution and ordinance, approved on first
<br />reading at the Public Hearing meeting of July 11, 1994, was
<br />adopted and by the following vote:

<br />94-263 (e):
<br />
<br /> "A RESOLUTION AMENDING GROUP HOUSING USE PERMIT (GHP-93-3),
<br />PERTAINING TO 160 CONDOMINIUM UNITS ON RIVER~POINTE PARKWAY ~N A
<br />PORTION OF TAX MAP 709, PARCEL 1.2.
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia,
<br />on August 24, 1993, approved the application of River Pointe
<br />Associates, L.L.C., for a Group Housing Use Permit (GHP-93-3),
<br />for the construction of 160 condominium units on River Pointe
<br />Parkway on a portion of Tax Map 709, parcel 1.2; and
<br />
<br /> WHEREAS, the applicant, River Pointe Associates, L.L.C.,
<br />has applied for an amendment to Condition 2(b) of said Group
<br />Housing Use Permit; and
<br />
<br /> WHEREAS, pursuant to Section 40-113 of the Zoning
<br />Ordinance, the Planning Commission has reviewed the application
<br />and has recommended approval of the amendment to Group Housing
<br />Use Permit (GHP-93-3).
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City
<br />of Portsmouth, Virginia:
<br />
<br /> 1. That Condition 2(b) of Group Housing Use Permit
<br />(GHP-93-3), is hereby amended to read as follows:
<br />
<br />The exterior of the condominium units shall be constructed of
<br />the same materials and architectural designs and details used in
<br />the "Wimbledon Chase" development in Chesapeake, Virginia,
<br />except that Heartland Manor vinyl siding may be installed
<br />instead of Charlestown beaded vinyl siding. Architectural
<br />changes may be approved by the Planning Commission prior to the
<br />issuance of a building permit.
<br />
<br />2. That all other conditions and requirements of Group Housing
<br />Use Permit {GHP-93-3), approved on August 24, 1993, and not
<br />modified by this resolution, shall remain in full force and
<br />effect."

<br />CITY MANAGER'S REPORT
<br />
<br />94-295 -Letter from the City Manager recommending adoption of
<br />an ordinance to appropriate $517,000 from the<~Capital
<br />Improvements Fund and $180,000 from the Public Utilities Capital
<br />Improvements Fund to complete Phase III of the continuing phased
<br />improvements in the Brighton/South Portsmouth area, and a motion
<br />to award the contract to Precon Construction Company.
