Sept~er 12, 1994 At the Public Hearing Meeting of the City Council held on Monday, September 12, 1994, there were present: Mayor Gloria O. Webb, Vice Mayor Johnny M. Clemons, Bernard D. Griffin, James C. Hawks, James T. Martin, Cameron Pitts, P. Ward Robinett, Jr., C. W. McCoy, Assistant City Manager, Stuart E. Katz, City Attorney. Vice Mayor Clemons opened the meeting with prayer which was followed by the Pledge of Allegiance to the Flag. The Mayor called the meeting to order and welcomed all in attendance. 94-353 Public Hearing on rezoning, group housing permit, use permit applications and a code amendment and the Comprehensive Plan: (a) Z-94-06 CHURCHLAND NEIGHBORHOOD - Rezoning application of River Pointe Associates to modify a condition to allow the development of condominium units on property to the west of River Pointe Parkway and south of West Norfolk Road. William E. Uebelhoer, 3143 Magic Hollow Blvd., spoke in favor of the application. Motion by Mr. Hawks, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission, that Z-94-06 be approved, and was adopted by unanimous vote. (b) GHP- 94-02 CHURCHLAND NEIGHBORHOOD - Group Housing project application of River Pointe Associates for single-family condominium development on property to the west of River Pointe Parkway and south of West Norfolk Road. Motion by Mr. Martin, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission, that GHP-94-02 be approved, and was adopted by unanimous vote. (c) UP-94-11 HIGHLAND-BILTMORE NEIGHBORHOOD - Use permit application of Ms. Sarah Grant to use 3720 Deep Creek Boulevard for a residential adult care home. Councilman James Martin abstained from voting because he previously represented Mrs. Grant. R. W. Brinson, 14 Maupin Avenue, spoke in opposition to the application. Robert Lawrence, 245 Beacon Road, representing the Highland Biltmore Civic League, spoke in opposition to the application. Rev. Kevin Wilson, 101 Wright Avenue, representing the Highland Baptist Church, spoke in opposition to the application. Sarah Grant, 410 Avondale Road, spoke in favor of the application~ Marvin Grant, 410 Avondale Road, spoke in favor of the application~ · Windell Green, 925 Brlndle Way, Chesapeake, spoke in favor of the application.
