'~ Ayes= Clemons, Griffin, Hawks, Martin, Pitts~ Rohinett Nays= None 94-408 Letter from the City Manager recommending adoption of an ordinance to amend Chapter 30 of the Code of the City of Portsmouth, Virginia by amending Sections 30-116(c) and 30-236(c) pertaining to retirement systems. "During the process of amending the retirement code to include the provisions of the "3-2-1" system for the present fire and police personnel, clarification of the ~tatus of our veste~, but inactive, former employees was not addressed. Employees who have completed the;number of years of service, but who leave prior to being eligible for retirement benefits, are called "vested inactive." These individuals have gone on to pursue other careers or employment elsewhere. However, because they were at one time firefighters/police officers or individuals authorized to be in the fire/police retirement system, and have completed the number of ~ears to become vested, they are eligible to receive benefits when they reach age 60. So as to ensure your intent not to extend the "3-2-1" program to those individuals who were not active employees of the City last July, I have requested the City Attorney to prepare the attached ordinance. In addition to modification to the Fire and Police Retirement System, the ordinance makes similar changes to the Portsmouth Supplement Retirement System. It clarifies that the benefits to be received by the vested, inactive members are based on the benefit package in existence at the time of leaving employment with the City. I recommend adoption of the ordinance to clarify that former employees who became vested before terminating their employment with the City, will receive the benefits of the system that were in effect at the time they left." Motion by Mr. Hawks, and seconded by Mr. Robinett, to adopt the following ordinance, and was adopted by the following vote= .AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988}, BY AMENDING SECTIONS 30-116 (C) AND 30-236(C) THEREOF, PERTAINING TO RETIREMENT SYSTEMS."
