October 25, 1994 <br /> <br />(c) The project shall be developed in accordance with the <br />approved site plan, including landscaping, <br /> <br />(d) The applicant shall screen or buffer <br />public view from Portsmouth Boulevard; <br /> <br />509 <br /> <br />building and parking; <br />the parking area from <br /> <br />(e) The applicant shall protect and preserve all mature trees <br />on the site, to the extent possible; <br /> <br />{f) The applicant shall install a six foot (6') high wooden <br />privacy fence around the rear property line, backyard and child <br />play area; <br /> <br />(g) Any revisions to the approved site plan shall be submitted <br />to the Planning Department for review and approval prior to the <br />issuance of a building permit; <br /> <br />(h) The number of children in the outdoor play area at any one <br />time shall-be limited so as to provide a minimum of two hundred <br />(200) square feet of play area per child; <br /> <br />(i) The applicant may apply for tax exempt status for the <br />property in accordance with state code provisions; <br /> <br />(j) The applicant shall comply with all applicable code, <br />ordinances and regulations of federal, state and local <br />governments, and shall obtain and maintain in effect all <br />required licenses and permits." <br /> <br />Ayes: Clemons, Hawks, Martin, Pitts, Robinett <br />Nays: Griffin, Webb <br /> <br />94-398 (s): <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Robinett, to <br />adopt the following ordinance, approved on first reading on <br />October 10, 1994, was adopted by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 33-32(7) <br />THEREOF, PERTAINING TO SIDEWALKS." <br /> <br />Ayes: Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: Clemons <br /> <br />94-398 (g): <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Hawks, to adopt <br />the following ordinance, approved on first reading on October <br />10, 1994, was adopted by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING TABLE 40-44.1 <br />THEREOF, PERTAINING TO MINIMUM LOTS WIDTHS." <br /> <br />Ayes: Clemons, Hawks, Pitts, Webb <br />Nays: Martin, Robinett <br />Abstained: Griffin (due to property ownership) <br /> <br />- CITY MANAGER'S REPORT <br /> <br />94-424 Letter from the City Manager recommending adoption of a <br />resolution appointing v~ewers for the closing of Ruth Brown <br />Avenue between Lincoln and Wavy Streets, Henry Street between <br />First and Third Streets, and Randolph Street between Third and <br />First Streets. <br /> <br /> <br />
