October 25, 1994 (c) The project shall be developed in accordance with the approved site plan, including landscaping, (d) The applicant shall screen or buffer public view from Portsmouth Boulevard; 509 building and parking; the parking area from (e) The applicant shall protect and preserve all mature trees on the site, to the extent possible; {f) The applicant shall install a six foot (6') high wooden privacy fence around the rear property line, backyard and child play area; (g) Any revisions to the approved site plan shall be submitted to the Planning Department for review and approval prior to the issuance of a building permit; (h) The number of children in the outdoor play area at any one time shall-be limited so as to provide a minimum of two hundred (200) square feet of play area per child; (i) The applicant may apply for tax exempt status for the property in accordance with state code provisions; (j) The applicant shall comply with all applicable code, ordinances and regulations of federal, state and local governments, and shall obtain and maintain in effect all required licenses and permits." Ayes: Clemons, Hawks, Martin, Pitts, Robinett Nays: Griffin, Webb 94-398 (s): Motion by Mr. Griffin, and seconded by Mr. Robinett, to adopt the following ordinance, approved on first reading on October 10, 1994, was adopted by the following vote: "AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 33-32(7) THEREOF, PERTAINING TO SIDEWALKS." Ayes: Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: Clemons 94-398 (g): Motion by Mr. Clemons, and seconded by Mr. Hawks, to adopt the following ordinance, approved on first reading on October 10, 1994, was adopted by the following vote: "AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING TABLE 40-44.1 THEREOF, PERTAINING TO MINIMUM LOTS WIDTHS." Ayes: Clemons, Hawks, Pitts, Webb Nays: Martin, Robinett Abstained: Griffin (due to property ownership) - CITY MANAGER'S REPORT 94-424 Letter from the City Manager recommending adoption of a resolution appointing v~ewers for the closing of Ruth Brown Avenue between Lincoln and Wavy Streets, Henry Street between First and Third Streets, and Randolph Street between Third and First Streets.
