October 25~I994 <br /> <br /> WHEREAS~ Diane Pomeroy,~Griffin, Attorney for the <br />applicant, G~rls Incorporated Center:for Youth of Southwest <br />Hampton Roads, has made application pursuant to ~40-43.1 of the <br />Code of the City of Portsmouth, Virginia (1988), for the <br />granting of a use permit to operate a youth center/child day <br />care center at 5815-5851-5901 Portsmouth Boulevard, Portsmouth, <br />Virginia, as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />is <br /> <br />(a) <br />residing or working an the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious <br />the property or ~mprovements in the ne~gb_borhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a <br />plan for parking; driveways and curb cuts which will provide <br />for safe and convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br /> 1. That the use for which the hereinafter-described permit <br />sought: <br /> <br /> Will not adversely affect the health and safety of persons <br /> <br />to <br /> <br /> 2. That Girls Incorporated Center for Youth of SoUthwest <br />Hampton Roads is hereby granted a use permit pursuant to <br />~40-43.1 of the Code of the City of portsmouth, Virginia <br />(1988), for the operation of a youth center/child day care <br />center on property located at~5815'5851~5901 Portsmouth <br />Boulevard, Portsmouth, virginia, and being more particularly <br />described as: <br /> <br />Beginning at a point 650.70 feet east of the intersectionof <br />Portsmouth Boulevard and Hodges Manor Road along the southern <br />right-of-way of Portsmouth Boulevard; thence 307.3I~ feet <br />S77'38'00" E to a point; thence 354.19 feet S7'53'16"E to a <br />point; thence 351.93 feet N77'39'00"W to a point; thence <br />171.47 feet~ N6'21'00"E to a point; thence 65.18 feet <br />N45'08'00W to a point; thence 126.85 feet N10'05'00"E to the <br />point of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br /> following conditions: ~ <br /> <br />(a) The entrance and exit to the site shall be aligned with <br />Charlotte Drive at Portsmouth Boulevard. Under the general <br />direction of the City's Traffic Engineer, the applicant will <br />work cooperatively with the owner(s) of property described as <br />Tax Map 616, Parcel 14, to develop a co~on street access for <br />both properties to Portsmouth Boulevard. This may include, but <br />shall not be limited to, granting an ingresS/egress easement; <br /> <br />(b) The applicant shall obtain annual fire and bUilding code <br />inspections and shall promptly correct any deficiencies noted; <br /> <br /> <br />
