<br />Common 0ouncii, who shall within ninety days from adoption of resolution, recommend to the Coun-
<br />cil such changes in the boundaries o~ the Wards of the City, the representation therefrom, and
<br />the names or numbers of the Wards, as they may deem expedient.
<br />
<br /> To adopt a resolution concerning members of the Council attending meetings of the two bran-
<br />ohos with a reasonable degree of r~gularlty.

<br />All of the above were concurred in.
<br />
<br /> Third. Matter adopted by the Joint Session December ?th and referred to each branch of
<br />Council separately for concurrence.

<br />The Budget of Anticipated Receipts and Expenditures for the Year 1916.

<br />Fourth. Communications from the Mayor.
<br />
<br /> The Mayor returned his approval of the following matters adopted by the two branches of
<br />City Council November 9-16th, 1915:
<br />
<br /> An appropriation of $9B5.00, out of Seventh Ward Bond Account, to be used in the Seventh
<br />Ward as follow.s: ~50. for pipe line in Prentis Park; $150. for pipe line at LincoLn and Wash-
<br />inEton streets, $300. for re~airs to cono~ete corners on paved streets; and SBB5. for repairs
<br />to,holes in paved streets.
<br /> $$75.00, out of Sixth Ward Bond Account, to have Fifth and Sixth avenues ditched and g~ad~d.
<br /> A special appropriation of $175. to improva the condition of the boiler room, &c., of the
<br />Municipal Bui 1 ding.
<br /> To make available the unexpended balance of the SS00. allowed in the Budget of 1915 for
<br /> "Court Room," fe-r purchase of chairs and linoleum in the same.
<br /> To pay to the Portsmouth Suburban Water Cot $6,547.?1 as net balance duc by the City to
<br />said Company for water supplies to the Cit.y in~ the Sixth and Eeventh Wards up to and zncludlng
<br />Sept. ~0~ 1915. (See accompanying resolutzon)o
<br /> To instruct the Auditor to refund to the Portsmouth Savings and Loan 0orporation SE00. paid
<br />in excess for license tax, in accordance with an order of Court in the case of the Industrial
<br />Loan Corporat ion.
<br /> To grant rudder the usual conditions the following petitions of The Chesapeake & Potomac
<br />Telephon~ Co.: let, to erect certain poles, as shown by copy of drawing attached to petition;
<br />~nd, to erect, remove, and replace poles on certain streets, and to construct 1~5 feet of E-way
<br />creosote wood conduit on Glasgow street, west of Hatton street; ~rd, to erect and replace poles
<br />on certain streets, as shown by copy of drawing attached to petition.
<br /> Street Committee authorized to advertise for. bids to build a conduit across the south end
<br />of Dinwiddie street, in accordance, with Plan No. B adopted for same.
<br /> ~To allow the City Attorney $.10.8.30 as writ ~ax, printing of records, &c., in the sase of
<br />the city of Portsmouth vs. Jobson (appealed to the Supreme Court of Appeals).
<br /> City Treasurer authorized to renew notes to amount of $47,500. falling due in Deeember, 191$.
<br />~ C~ity Attorney authorized and instructed to apply to the Supreme Court of Appeals for a 'writ
<br />o~ e. rror in t.he case of .the Portsmouth & Nor.folk Corporation vs. the City to recover $5,000. de-
<br />poszted by sa~-d Corporatzon,with bid to furnish a contract for lighting the City with electri-
<br />city.
<br /> . Almshouse Committee authorized to advertise for bids to supply the Almshouse with rations
<br />and the poor of the City with medicines, for the year i916.
<br />
<br />Fifth. Reports of Officers and other unfinished business.
<br />
<br /> The regular reports of Officers for the month of November, 1915, were presented and were
<br />ordered to ~ake.the usual course.
<br />
<br />The following opinion was read from the City Attorney and referred to the Finance 0ommittee:
<br />
<br /> "Portsmouth, Va., December 14, 1915.
<br /> "To the Hon. City Council,
<br /> "Portsmouth, Va.
<br /> ~Gentlemen:--
<br /> "Replying to your communication calling for my opinion as to the right of
<br />the Clerk of Court to charge the City for services rendered in making up the record in the case
<br />of Ellis B. Jobson against the City; the Clerk receiving a salary of $600 per annum, paid by
<br />the City, I beg to say:
<br /> "~hat
<br /> I can find nothing in the generaliaw, nor in th~ City Charter, nor in the ordinance
<br />allowing such compensation, which deprives him of his fees fixed by law for such services, Hence
<br />I conclude that the bill presented by him is proper and should be allowed.
<br /> "I have been requested by his Honor, the Mayor, to giv? my opinion as to the right of the
<br />Clerk of th, Court to use the stationery furnished by the ~zty for hie own private use and for
<br />those f=om-~'~hom he receives compensation, to which I rept~ that. neither he nor any other offi-
<br />cer has such a right. It is but fair to the Clerk to say that he denies such to be the case.
