<br />94-489.- Letter~ from the C~ty Manager presenting a resolution
<br />exempting the Girls Incorporated Center for Youth of Southwest
<br />Hampton Roads from taxation within the context of 6(a) (6) of
<br />Article X of the Constitution of Virginia.
<br />
<br /> "Girls Incorporated Center for Youth of Southwest Hampton
<br />Roads, a charitable organization, has applied for exemption from
<br />taxation within the context of 6(a} (6) of Article X of the
<br />Constitution of Virginia. The City Assessor has reviewed the
<br />application, and it is his opinion that the appropriate
<br />responses were completed and meet the criteria for you to vote
<br />on the exemption.

<br /> While my position on this matter is very clear, this item
<br />is being presented to you for your consideration. Your
<br />favorable consideration will require that you adopt a resolution
<br />to be forwarded to the appropriate legislative representatives."

<br /> Motion by Mr. Hawks, and seconded by Mr. Clemons, to adopt
<br />the following resolution, and was adopted by the following vote:
<br />
<br /> "A RESOLUTION SUPPORTING THE APPLICATION OF GIRLS
<br />INCORPORATED CENTER FOR YOUTH OF SOUTHWEST HAMPTON ROADS, FOR
<br />DESIGNATION AS A CHARITABLE AND BENEVOLENT ORGANIZATION WITHIN
<br />THE CONTEXT OF SECTION 6 (a) (6) OF ARTICLE X OF THE
<br />CONSTITUTION OF VIRGINIA.
<br />
<br /> WHEREAS, mn accordance with Section 30-19.04 of the Code of
<br />Virginia, 1950, as amended, the Council of the City of
<br />Portsmouth, Virginia held a Public Hearing on Tuesday, December
<br />13, 1994, to consider the application for exemption from taxes
<br />filed on behalf of Girl's Incorporation Center for Youth of
<br />Southwest H~mpton Roads, for real property located at 5851
<br />Portsmouth Boulevard, Portsmouth, Virginia, and used by the
<br />applicant exclusively for charitable and benevolent purposes on
<br />a non-profit basis as set forth in Section 58.1-3650 of the Code
<br />of Virginia, 1950, as ~unended; and
<br />
<br />WHEREAS, the Council of the City of Portsmouth, Virginia
<br />has examined and considered the provisions of Section 30-19.04
<br />(B) of the Code of Virginia, 1950, as sanended, with respect to
<br />the petition of Girl's Incorporated Center for Youth of
<br />Southwest Hampton Roads.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the City
<br />of Portsmouth, Virginia, supports the request of Girl's
<br />Incorporated Center for Youth of Southwest Hampton Roads, a
<br />non-profit organization, for designation as a charitable and
<br />benevolent organization within the context of Section 6 (a) (6)
<br />of Article X of the Constitution of Virglnla and that its real
<br />property located at 5851 Portsmouth Boulevard, in the City of
<br />Portsmouth, Virg~nla, owned by it and used by it exclusively for
<br />charitable and benevolent purposes on a non-profit basis, be
<br />determined to be exempt from taxation in accordance with Section
<br />58.1-3650 et seq., of the Code of Virginia, 1950, as amended.
<br />
<br /> BE IT FURTHER RESOLVED that the City Clerk be, and she
<br />hereby is, directed to forward copies of this Resolution to
<br />State Senators L. Louise Lucas and Frederick M. Quayle and
<br />Delegates Kenneth R. Melvin and William S. Moore, Jr."
