September 10, 2002 <br /> <br />(c) UP-02-15 <br /> <br />DOWNTOWN NEIGHBORHOOD - Isaac William requests to <br />convert a restaurant into an entertainment establishment at 623 <br />High Street. The Comprehensive Plan recommends commercial <br />use. <br /> <br />1. Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in support of this item. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Pitts, to concur with the <br />recommendation of the Planning Commission that UP-02-15 be approved on first <br />reading. <br /> <br /> Substitute motion by Mr. Whitehurst, and seconded by Mr. Moody, to delay <br />UP-02-15 until the Interim City Manager returns with a staff report and recommendation, <br />and was defeated by a vote of 4-3. (Moody, Randall, Whitehurst) <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Pitts, to concur with the <br />recommendation of the Planning Commission that UP-02-15 be approved on first <br />reading, and was by adopted by a vote of 5-2. (Moody, Whitehurst) <br /> <br />(d) Z-02-08 <br /> <br />WESTHAVEN NEIGHBORHOOD - Robert A. Thronton requests <br />rezoning from OR-75K to RS-75 at 410 Westmoreland Avenue for a <br />single-family residence. The Comprehensive Plan recommends <br />single-family development of the area. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that Z-02-08 be approved on first reading, <br />and was adopted by unanimous vote. <br /> <br />(e) U P-02-16 <br /> <br />TRUXTUN NEIGHBORHOOD Mount Carmel Community <br />Development Corporation requests a use permit to operate an <br />outreach center at 2210 and 2330 Portsmouth Boulevard. The <br />Comprehensive Plan recommends commercial uses in this area. <br /> <br />1. Martha Ann Creecy, 317 Dinwiddie Street, spoke in opposition to this item. <br /> <br />2. Reverend Shirley Hines, 1801 High Street, spoke in support of this item. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Benn, to concur with the <br />recommendation of the Planning Commission that UP-02-16 be approved on first <br />reading, and was adopted by a vote of 6-1. (Moody) <br /> <br />(f) CA-02-04 <br /> <br />CITYVVlDE - The City of Portsmouth requests a Code Amendment <br />to Chapter 40, Article Xll, Section 40-151, to increase the fees of <br />rezonings, use permits, Board of Zoning Appeals, site plan review <br />and engineering inspection fees. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that CA-02-04 be approved on first <br />reading, and was adopted by unanimous vote. <br /> <br />- Unfinished Business - <br /> <br />02 - 242 - Use permit: <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Pitts, to adopt the following resolution, <br />approved at the August 27, 2002 meeting, and was adopted by the following vote: <br /> <br />02-242(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO HERBERT POTTS FOR THE <br />OPERATION OF A CHILD CARE CENTER AT 1017 SEVENTH STREET. <br /> <br /> WHEREAS, Herbert Potts has made application pursuant to Section 40-43.1 of <br />the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to <br />operate a child care center (SIC 835) at 1017 Seventh Street, Portsmouth, Virginia; and <br /> <br /> <br />
