September 10, 2002 <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended granting the <br />application for an amended use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Herbert Potts is hereby granted a use permit pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child care <br />center on property located at 1017 Seventh Street, and being more particularly <br />described as: <br /> <br />UP-02-12 <br /> <br />Beginning at the northwest corner of Seventh and Madison <br />Streets; thence, in a northerly direction 121'_+ to a point; <br />thence, in a westerly direction 134.18'_+ to a point; thence, in <br />a southerly direction 121'_+ to a point; thence, in an easterly <br />direction 128.6'_+ to a point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br /> (a) The occupancy of the child care center shall be limited to no more than <br />thirty-five (35) children. <br /> <br />(b) Indoor hours of operation shall be limited to 6:00 a.m. to 6:00 p.m. <br /> <br /> (c) <br />6:00 p.m. <br /> <br />Outdoor play hours shall be limited to the hours between 8:00 a.m. and <br /> <br /> (d) The 3,795 square foot outdoor play area shall be enclosed with a privacy <br />fence eight (8) feet in height. <br /> <br /> (e) The applicant shall maintain at least six (6) off-street parking spaces for <br />the child care center. <br /> <br /> (f) The center shall comply with the submitted site plan and floor plan. The <br />center shall also comply with the submitted front elevation, dated August 15, 2002. The <br />side and rear elevations shall be architecturally consistent with the submitted front <br />elevation. <br /> <br /> (g) The applicant shall present a landscaping plan and detailed architectural <br />plans for Planning Staff approval. <br /> <br /> <br />
