<br /> At a Regular Meeting of the City Council on Tuesday, September 10, 2002,
<br />there were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts,
<br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W.
<br />Randall, Interim City Manager C. W. McCoy, City Attorney G. Timothy Oksman.
<br />
<br /> Councilman J. Thomas Benn III opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a
<br />Called Meeting on August 27, 2002, and a Regular Meeting on August 27, 2002, and
<br />was adopted by unanimous vote.
<br />
<br />02 - 273 - Presentation:
<br />
<br />· Proclamation presented to Helen Person for receiving the "Frank R. Parker Award".
<br />
<br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, suspend Council's Rules to
<br />allow non-agenda speakers with disabilities to speak prior to the public hearing, and
<br />was adopted by unanimous vote.
<br />
<br />1. Virginia Sprague, 4532 Delmar Drive, Virginia Beach, expressed appreciation for
<br /> accessibility for the disabled people at the nTelos Pavilion.
<br />
<br />2. Jennifer Thornburg, 1213 Edenham Court, Apt #102, Virginia Beach, expressed
<br /> appreciation for accessibility for the disabled people at the nTelos Pavilion.
<br />
<br />3. Jacoby Harvey, 114 Cromwell Parkway, Norfolk, expressed appreciation for
<br /> accessibility for the disabled people at the nTelos Pavilion.
<br />
<br />Robert A. Baldwin, Director of the Department of Planning and Inspection introduced
<br />Wallace Robert & Todd, LLC, Lead Planning Consultant for the Comprehensive
<br />Plan.

<br />- Public Hearing -
<br />
<br />02 - 274 - Public hearing on use permit, rezoning and street closure applications:
<br />
<br />(a) UP-02-17
<br />
<br />BRIGHTON NEIGHBORHOOD - Loretta Armstrong requests a use
<br />permit for a childcare center at 2900 Elm Avenue, 1211 Centre
<br />Avenue and 2814 Elm Avenue. The Comprehensive Plan
<br />recommends single-family development of these properties.
<br />
<br />1. Loretta Armstrong, 1333 Watson Street, spoke in support of this item.
<br />
<br /> Motion by Mr. Benn, and seconded by Mr. Griffin, to concur with the
<br />recommendation of the Planning Commission that UP-02-17 be approved on first
<br />reading, and was adopted by unanimous vote.
<br />
<br />(b) Z-02-09
<br />
<br />DOWNTOWN NEIGHBORHOOD - Van John Hildreth requests a
<br />rezoning of the property located at 901, 905, 907, and 915 High
<br />Street, and 508, 520 and 528 Chestnut Street from Downtown D-2
<br />Industrial to Downtown D-2 Mixed. The Comprehensive Plan
<br />recommends commercial development of the area.
<br />
<br />1. Van John Hildreth, 145 West 17th Street, New York, NY, spoke in support of this
<br />item.
<br />
<br /> Motion by Mr. Griffin, and seconded by Mr. Benn, to concur with the
<br />recommendation of the Planning Commission that Z-02-09 be approved on first reading,
<br />and was by adopted by unanimous vote.
