March 14, 1995 <br /> <br />95-121 - Letter from the City Manager recommending adoption of <br />an ordinance to appropriate $25,000 from the Capital <br />Improvements Fund for installation of wheelchair curb ramps. <br /> <br /> "Included in the recently approved 1994-99 Capital <br />Improvements Fund is $25,000 for installation of wheelchair <br />curb ramps an compliance with the Americans with Disabilities <br />Act of 1990. These funds are utilized to provide accommodation <br />to those with disabilities on a priority basis. <br /> <br /> The Director of Public Works recommends that $25,000 be <br />appropriated from the Capital Improvements Fund. I concur and, <br />with your approval of this item, the balance in the Capital <br />Improvements Fund will be $17,493,074." <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Hawks, to <br />adopt the following ordinance, and was adopted by the following <br />vote: <br /> <br /> "AN ORDINANCE TO APPROPRIATE $25,000.00 FROM THE CAPITAL <br />IMPROVEMENTS FUND FOR THE INSTALLATION OF WHEELCHAIR CURB CUTS <br />FOR COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT OF <br />1990." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />95-122 Letter from the City Manager recommending adoption of <br />an ordinance to amend Sections 22-565(b) and 22-583(a) of the <br />City Code, pertaining to violation of City parking violations. <br /> <br /> "As the Chief of Police briefed you, the police department <br />is preparing to begin use of an automated and computerized <br />system for citing those who are in violation of city parking <br />ordinances. In so doing, a review of these ordinances and the <br />penalties for their violation was undertaken and on January 24, <br />1995 you approved changes to Chapter 22 of the City Code <br />pertaining to motor vehicles and parking violations. These <br />revisions to the City Code will provide for a $10 fine which <br />was inadvertently omitted for certain parking violations in <br />restricted areas, and provide more definition to the penalty <br />for violation of Section 22-565. <br /> <br /> I, therefore, recommend adoption of this ordinance to the <br />City Code setting the penalty for certain parking violations." <br /> <br /> Motion by Mr.'Pitts, and seconded by Mr, Robinett, to <br />adopt the following ordinance, and was adopted by the following <br />vote: <br /> <br /> "AN ORDINANCE AMENDING SECTION 22-565(B) AND SECTION <br />22-583(A} OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA <br />(1988), AS AMENDED, PERTAINING TO PROCEDURES AND PENALTIES FOR <br />PARKING VIOLATIONS." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />95-123 - Letter from the City Manager recommending adoption of <br />a resolution requesting the Virginia Department of <br />Transportation's approval of additions, deletions, and changes <br />in functional classification of certain City streets eligible <br />for State maintenance payments. <br /> <br /> "Each year the City of Portsmouth submits to the Virginia <br />Department of Transportation a list of additions, deletions and <br />changes to the streets eligible for maintenance payments under <br />the State Functional Classification System as set forth in <br />Section 33.1-41.1 of the Code. These roadway sections are <br />located primarily in new subdivisions where the streets were <br />recently completed by the developers. <br /> <br /> <br />
