The Virgin£a ~epartment of Transportation requires that these lists be a;CCompanied by a city Council resolution. I, therefore, recommend your approval of the attached resolution to accompany our submission for highway maintenance payments." Motion by Mr. Martin, and seconded by Mr. Clemons, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF TRANSPORTATION TO APPROVE CERTAIN ADDITIONS, DELETIONS AND CHANGES IN FUNCTIONAL CLASSIFICATION OF STREETS IN THE CITY OF PORTSMOUTH FOR THE PURPOSE OF CALCULATING MAINTENANCE PAYMENTS. WHEREAS, the regulations of the Virginia Department of Transportation adopted pursuant to Section 33.1-41.1, Code of Virginia, require that the City submit a request for mileage additions, deletions and changes in functional classification of streets which occurred during the fiscal year; and WHEREAS, the following described changes in mileage have occurred in the City of PortsmoUth for the reasons specified. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the Virginia Department of Transportation be requested to approve the following additions, deletions and changes in functional classification for streets in the City of Portsmouth for the purpose of calculating maintenance payments: A. ADDITIONS 1. Candlelight Lane from River Pointe Drive to cul-de-sac. 2. Columbia Court from South Street to loop. 3. Columbia Court from loop back to loop. B. DELETIONS 1 Park Manor spur from City Park Avenue to Park Manor Road. 2 Ruth Brown Avenue from Lincoln Street to Randolph Street. 3 Ruth Brown Avenue from Randolph Street to Wythe Street. 4 Henry Street from First Street to Second Street. 5 Randolph Street from First Street to Second Street. Randolph Street from Second Street to .29 miles west of Second Street." Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None 95-124 - Letter from the City Manager recommending adoption of a motion to refund $74.43, with interest, to Stephen W. and Karen G. Arban. "The City Assessor is requesting a refund of $74.43, with interest, to Stephen W. & Karen G. Arban, of 3811 Magnolia Drive, Portsmouth, Virginia, 23703. The building was erroneously listed with a stall shower bath, resulting in an overassessment. The refund is for real estate taxes assessed and paid in error for the FY 1991-92, 1992-93 and 1993-94. I recommend your approval of this motion for a refund with interest."
