<br /> "In accordance with the resolution of the 0ouncil, the Manager attempted ~ $~$~ & price
<br />from the owners of the several lots and they have declined to give it. .He has, ~herefore,
<br />taken the assessed value of the property as 75% of the true value and the prices inserted
<br />in the resolution a~e the values obtained in.this manner.,
<br /> The Manager recommended the passage of the resolution, which is as foll$ws:

<br /> "RESOLVED, ~ hat
<br /> "WHEREAS, by a resolution passed by the City Council of the City of
<br />Portsmouth on the 14th day of June, 1921, it was determined to acquire by purchase, condemna-
<br />tion, or otherwise, for the purpose of extending and enlarging the~wmter works cf said City,
<br />certain re&l estate adjacent to the Godwin Street pumping station, in the said resolution
<br />fully set forth and demcribed; an~ which resolution directed the City Manager to ascertain
<br />and report to this Council who a~e the owners of each lot of land mentioned in said resolution,
<br />and for what the said real ~state, or any part thereof, might.be purchased; and,
<br />
<br /> "WHEREAS, the City Mm~aEer, pursuant t~ the said resolution, has reported that S. ~. Cast
<br />is the owner of ~fou2 lots ~ block A, on the plat mentioned in said ~esolution, numbered from
<br />one to four, inclusive, and thaz Said S. P. Oast declined to say what price he would sell
<br />this property to th~ city for; that L. O. Irving and H. A. IrVing, jointly, are the owners
<br />of nineteen lots inblock A~on Smid plat, numbe=ed from five to fifteen, inclusive, and f~m
<br />nineteen to twenty-six, inclusive; and that L. O. and H. A. Irving and W. K. Hedges ~wn lots
<br />numbered from sixteen to eighteen, i~otusive, in said block and plat, the ~wo former owning
<br />a one half undivided interest and W~ K. Hedges the other bn~.~nalf undivided interest therein,
<br />who have stated that they d0 no~ wish to sell any of~the io~ts in Block A; mnd
<br />
<br /> "WHEREAS; the City Manager-has further reported that he has ascertained the fair market
<br />v~lue of the said real estate to be'as follows: Lots numbers one to four, inclusive, $10~6.00
<br />each; lot number five $266.00; and lots numbers six to twenty siX, inb~usive, $4200.00.

<br /> "Now, therefore, be it further resolved, b~ this City-Council That the City Mana er be,
<br />and he is hereby, directed to offer S. P. Oast $266. each for lots' g
<br /> numbers one
<br />elusive; thmt he offer L...~. Irving and H. A. Irving $266.00 for lot number five, and:$200. O0
<br />each for lots numbers six to fifteen and nineteen to twenty six, inclusive; and that he offer
<br />s~id L. O. Irving, H. A. IrVi~, and N. K. Hddges $200.00 each for lots numbers sixteen to
<br />eighteen, inclusive; and that he shall report to. the. next meeting of the council whether
<br />the said offers, or any of them, have been accepted,"

<br /> M~. White moved that the resolution be amended, to authorize the Manager to offer
<br />the owners of the lots named the assessed values for each lot. The amendment was mdopted,
<br />and then the resolution was mdopted, as amended, and by the following vote:

<br /> During the paSt~yea~, I was authorized informally by the Council to expend
<br />$5,000 in excess of the appropriation in the 9~h Nard. The amount available for repairs under
<br />Hig~wmys in this Ward is now emh~usted and I therefore request an m~iti0~at~appropriation
<br />of $3,300 to continue workof road repair ~o the end of the year. ~f this amount ~$2,000 is
<br />needed for Account 4~ ~=2,_$500~00 for 4, B-6, and $~00.00 for the purchase' of material.

<br /> On July-gth about ~:O0 P. M. trash car~ No. 10 driven by T. Curtis stopped
<br />on County ~treet at the northwest corner of Middle for the collection of some trash. ~ truck
<br />belonging to C. D._ Kenny came up and parked into the curb ahead of the cart. Employee~' of
<br />a second-hand furniture store o~that corner belonging to Mr. Scott were shaking some bed
<br />~prings, The ho=se bec~me frightened, reared up, coming ~own with his front feet on the
<br />rent fend~ of the Kenny truck, damaging the same to suc~ an extent that a new fender is nec-
<br />essa~y. The cost of this, as Shown on the inclosed bill, w~s $16.25. :
<br />
<br /> "This matter was referred to the City Attorney and he i~ of the opinion that the City is
<br />liable for the damage an~d~recommends that the bill be paidwith~ut litigation. I concur in
<br />his recommendation and ~ecommend~that I be authorize d~o pay the bill from the approprimtion
<br />
<br />for street cleaning.
