<br /> WHEREAS, it will be necessary to release and vacate a
<br />portion of the easements so reserved upon the construction and
<br />completion of the I.C. Norcom High School.
<br />
<br /> NOW, THEREFORE, BE iT RESOLVED by the Council of the City
<br />of Portsmouth, Virginia, that the City Manager be, and he
<br />hereby is authorized to release and vacate such portions of the
<br />perpetual easements, rights and privileges to install, operate,
<br />maintain and replace sewer mains, sewer drains, sanitary
<br />sewers, water mains and storm drains as reserved in the closed
<br />portions of Queen Street, Williamsburg Avenue and Lockport
<br />Street as may be necessary for the construction and completion
<br />of the I.C. Norcom High School, at such time and in such manner
<br />as he shall~deem appropriate and in the best interest of the
<br />City of Portsmouth, Virginia."

<br />95-182 - Letter from the City Manager recommending adoption of
<br />a resolution authorizing the City Attorney to proceed to
<br />institute eminent domain proceedings, as needed for the
<br />widening of Twin Pines Road.
<br />
<br /> "The City is preparing to widen Twin Pines Road from its
<br />intersection with Tow-ne Point Road to its intersection with
<br />Swannanoa Drive. The City has been unable to reach an
<br />agreement as to the purchase price with one property owner for
<br />a small portion of property needed for the widening.
<br />
<br /> I, therefore, reco~anend adoption of the attached
<br />resolution which authorizes the City Attorney to acquire this
<br />property by eminent domain proceedings, or by certificate Of
<br />taking."
<br />
<br /> Motion by Mr. Clemons, and seconded by Mr. Martin, to
<br />adopt the following resolutionr and was adopted by the
<br />following vote:
<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN
<br />PROPERTY OWNED BY DEBORAH L. DILLOW UNDER EMINENT DOMAIN
<br />PROCEEDINGS PURSUANT TO THE CHARTER OF THE CITY OF PORTSMOUTH,
<br />VIRGINIA, SAID PROPERTY BEING NECESSARY FOR THE WIDENING IN THE
<br />TWIN PINES ROAD PROJECT.
<br /> WHEREAS, the Council of the City of Portsmouth has
<br />determined it to be in the public interest to widen Twin Pines
<br />Road; and
<br /> WHEREAS, the City has not been able to purchase the
<br /> property described herein, necessary to the project, because
<br /> the owner thereof and the City have not been able to agree upon
<br /> the price to be paid therefor; and
<br /> WHEREAS, the advancement of the work and the use of said
<br /> property will be unreasonably delayed if said property is not
<br /> made available for the project as soon as possible.
<br /> NOW, THEREFORE, BE IT RESOLVED bY the Council of the City
<br /> of Portsmouth, Virginia, that the City Attorney be, and he
<br /> hereby is, directed to institute eminent domain proceedings,
<br /> including the filing of certificates of taking against the
<br /> hereinafter-described property situate in the City of
<br /> Portsmouth, Virginia, for the purpose of acquiring the fee
<br /> simple title thereto pursuant to Sections 2.06, 2.07 and 2.08
<br /> of the Charter of the City of Portsmouth, Virginia, as amended.
