May 14, 2002 <br /> <br /> WHEREAS, it appearing to the Council of the City of Portsmouth, Virginia that <br />the joint procurement of the Energy Services pursuant to the Joint Powers Agreement <br />and the provision of Steering Committee Services pursuant to the Joint Powers <br />Agreement is otherwise in the best interests of the City. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> (1) That competitive sealed bidding and competitive negotiation for the <br />procurement of Energy Services are not fiscally advantageous to the public because the <br />procurement process for Energy Services must be flexible enough to respond to quickly <br />changing market conditions in which energy prices can fluctuate considerably on a daily <br />or even hourly basis; <br /> <br /> (2) That the aggregation and joint procurement of the Energy Services <br />pursuant to the Joint Powers Agreement is hereby approved; <br /> <br /> (3) That the provision of Steering Committee Services pursuant to the Joint <br />Powers Agreement is hereby approved; <br /> <br /> (4) That the Joint Powers Agreement and the performance of the terms and <br />conditions thereof on behalf of the City are hereby authorized and approved; <br /> <br /> (5) That the Interim City Manager is hereby authorized and directed to <br />execute and deliver the Joint Powers Agreement on behalf of the City; <br /> <br /> (6) That the payment obligations of the City pursuant to the provisions hereof <br />and the Joint Powers Agreement shall be subject to annual appropriation of requisite <br />funds therefor by the City Council; and <br /> <br />(7) That this Resolution shall take effect on the date of its adoption." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />02 - 149 - Adoption of a resolution supporting the City's adoption of an Environmental <br />Police Statement. <br /> <br />This action will facilitate staff's understanding and implementation of the policies <br />of the Environmental Protection Agency and the Virginia Department of <br />Environmental Quality regarding the use of hazardous material and hazardous <br />waste accidents. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution supporting the City's adoption of an Environmental Policy <br />Statement. <br /> <br />Purpose and Need: <br /> <br />· Both the Environmental Protection Agency (EPA) and the Virginia Department of <br />Environmental Quality (DEQ) have endorsed the implementation of an Environmental <br />Management System for municipalities. In order to fully implement this system a <br />resolution is required by each participating municipality which supports the City's <br />Environmental Policy Statement. <br /> <br />· Adopting a comprehensive environmental policy will facilitate all City departments <br />and their employees in understanding and implementing EPA and DEQ policies <br />regarding the use, storage and disposal of hazardous wastes. <br /> <br />· This environmental policy will demonstrate the City's commitment to take a <br />responsible and proactive stance in protecting the environment and reducing the risks of <br />hazardous material and hazardous waste accidents. <br /> <br /> <br />
