.136 May 23, 1995 Charles S. Sullivan, 5119 Bennett's Pasture Road, Suffolk, provided information on the rezoning application. James L. Smith, 334 Middle Street, provided information on the rezoning application. Motion by Mr. Pitts, and seconded by Mr. Hawks, to concur with the recommendation of the Planning Commission that Z-95-05 be approved on first reading, and was adopted by unanimous vote. 95-222 - Use permit application: Motion by Mr. Robinett, and seconded by Mr. Martin, to concur with the recommendation of the Planning Commission that UP-95-01 be approved, and was adopted by the following vote: 95-222 (e): "A RESOLUTION GRANTING A USE PERMIT TO HASAN PEI~NIRCIOGLU FOR THE OPERATION OF A FLEA MARKET AT 3126 VICTORY BOULEVARD. WHEREAS, Hasan Peynircioglu has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a flea market at 3126 Victory Boulevard, Portsmouth, Virginia, as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said Use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the hereinafter-described permit is sought: (a) residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the pUblic use or injurious the property or improvements in the neighborhood; Will not adversely affect the health and safety of persons to (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be develOped according to a plan for parking, driveways and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Hasan Peynircioglu is hereby granted a use permit pursuant to Section 40-43.1 of!the Code of the City of Portsmouth, Virginia (1988) for the operation of a flea market on property located at 3126 Victory Boulevard, and being more particularly described as:
