May 23, 1995 <br />UP-95-01 <br /> <br /> BEGINNING at the southeastern corner of the property, <br />identified as Lot 2 on a plat entitled "Site Plan of 3118 <br />Victory Boulevard, Portsmouth, Virginia Proposed "FLEA <br />MARKET/USED CAR LOT", dated February 28, 1995, prepared by <br />Stephen I. Boone & Associates, P.C., Land Surveyors, and on file <br />in the Planning Department of the City of Portsmouth, Virginia, <br />thence in a northeasterly direction along the existing property <br />line approximately 160 feet to a chain link fence; thence in a <br />northwesterly direction approximately 163 feet to an existing <br />property line; thence in a southwesterly direction approximately <br />175 feet to the northern right-of-way line of Victory Boulevard; <br />thence in a southeasterly direction along said right-of-way <br />approximately 175 feet to the point of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) The site shall be buffered, landscaped and marked to <br />designate parking spaces and drive lanes as shown on Exhibit A, <br />attached hereto and made a part hereof. Concrete bumper blocks <br />shall be installed, as shown on Exhibit A. <br /> <br />(b) A six-foot high, dog-ear style wooden screening or privacy <br />fence shall be installed as shown on Exhibit A. The fence shall <br />be constructed with boards at least six (6) inches in width. <br /> <br />(c) A five-foot landscaping or planting bed, as shown on <br />Exhibit A, shall be constructed by digging out the existing <br />concrete to an adequate depth and installing suitable soil. Wax <br />myrtle, 2-3 feet in height, shall be planted at six-foot <br />intervals. Plants shall be maintained in good condition for the <br />duration of the use permit. <br /> <br /> (d) Additional lighting, as recommended by the crime prevention <br />unit of the police department, shall be installed. <br /> <br />(e) Ail required improvements, including fencing, landscaping, <br />bumper blocks, lighting and pavement marking shall be completed <br />within sixty (60) days of approval.of the use permit. <br /> <br />(f) Items for sale at the flea market shall not be displayed on <br />the Victory Boulevard side of the screened flea market display <br />area as shown on Exhibit A. <br /> <br />(g) The applicant shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments and shall obtain and maintain in effect all <br />necessary licenses and permits. <br /> <br />(h) The use permit shall not be transferable." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />CITY MANAGER'S REPORT <br /> <br />95-253 Letter from the City Manager recommending adoption of <br />an ordinance to appropriate $1,150,000 from the Capital <br />Improvements Fund for a three-bay fire station at Rivershore <br />Road and Cedar Lane, and a motion to award the contract to <br />Reliable Builders, Inc. <br /> <br /> a.
