A recent case, however, h~s brought authority into <br />question. I am therefore submitting an ordinance which will clarify this question, and its <br />passage is recommended.~ <br /> An Ordinance Authorizing the Oity Manager to set Aside Parki~_~ces ~r,Oertaln <br />Purposes and to DesignatorS'topping Places for Jitneys in the City o~ ~ormsmou ~. <br /> <br /> On motioD cf Mr. White, the ordinance was~placed on its first reading. <br /> 5th, "I am of the opinion that the following provisions cf State law should be paralleled <br />by 0ity ordinance, in order thmt the fines accraing may come into the Otty treasury: Drinking <br />in Public Places, Obstructing Justice, Operating Oar While Intoxicated, Drunk and Fo~ication. <br />The 0ity Ordinances shou~-d provide penalty not less severe than those imposed by State law <br />and should also make provision for the same fees to arresting and prosecuting officers as <br />are provided by State law. <br /> <br /> It is recommended that the Oity Attorney prepare these ordinances as soon as <br />practicable in order that the City may not lose income from fines." <br /> <br /> On motion of Mr. White, the reCommendaiie~of~%he N~_..r~.~ger was concurred in. <br /> <br /> 6th. "Judge Ha~ry 0uthriell has made recommendation to me that a small monthly allowance <br />be made to Mary Jennings, who D~dles colored probation work. All colored girls are looked <br />after in her house at present without any expense for lodging and while ou~ finances do not <br />~oS~ify excessive expenditures, it does seem to me that we might make her an allowance of <br /> .O0 per month for this work and I am therefore makin~ that definite recommendation. <br /> <br /> Judge .Cuthriell would like to appeam before the Finance Oommlttee when this <br /> matter is considered." <br /> <br />On motion, the conmm~uication was referred to the Finance Committee. <br /> <br /> ~th. "On account of the sittings of the 0ircuit 0curt begtnni~ at lO:C0 A. M., it has <br />been necessary to transfer temporarily the.0ivil Oo~trt to the Police court room. This has <br />been the cause of considerable criticism and inconvenience amd I find it is possible to <br />fit up a very satisfactory court room in the old Hook and Ladder Oompany assembly room at <br />fire headquarters. The cost of .modi~icatioms and furniture including gas heaters for this <br />~oom'will be about $300°00. <br /> <br /> I believe it is ad,~'sable to do ~his work and am therefore recommending a special <br />appropriation of $300.00 fo= this purpose." <br /> <br />On motion, the recommendation was referred to Finance Committee° <br /> <br /> Eth. "I am forwarding herewith a letter from Judge B. D. White, relative to cou~t room. <br />This askJfor the constraction of certain rooms adjacent to the Oouncil 0hamber. <br /> <br /> ''t <br /> I believe that the~question of the Municipal Building should be definm ely disposed <br />of and if it is decided not to build the proposed building, '! am prepared to submit a plan <br />for additions to the present building which are in my opinion essential." <br /> <br /> On motion of Mr. White, the comm~mications were referred to the Oommittee on New Oity <br />and ~ounty Building. <br /> <br />._ 9th. "t am forwarding herewith bill of Mr. John E. Rapelye for $8,86~.83, claimed by <br />him in co~nection with extra work involved in placing shells fo-~ud to be necessary umder the <br />pipes comprised in the west High St. drainage contract. The City Emgineer and I have gone <br />carefu~lly into this matter and the City Engineer .finds ~ter full investigation that the net <br />amount due Mr. P~pelye is $2,334.6?. To this I think should be added a reasonable amount for <br />interest, Workm~'s Com~ensation Insurance and delay. Mr. R~pelye claims that his entire <br />gang ws~ delayed during the placing of the shells. This claim I can not admit, but I feel <br />that if twenty per cent is added to Mr. Weaver's estimate, Mr. Rapelye will be fully com- <br />p~n~ted for the extra expense involved in placing the~hells." <br /> <br /> I am ~h~re~cEe recommemd%ng that I be autherSzed to_pay to Mr. Rapelye the actual <br />expense which is $2~335.67, plus ~0~, making a total of $2,~1.60.~ <br /> <br />On motton,~e recommendation w~s referred to Finance Oom~ittee. <br /> <br />UNFINISHED BUSINESS <br /> <br />The following oommmmication was read from the Olty Attorney: <br /> <br /> "Portsmouth, Va., July 8, 1924o <br />Honorable 0ity 0ouncil, <br />~ortsmouth, Va. <br /> $~emen: <br /> At a meeting held on June third you referred to me a request from Mr. J. S. Piland <br />to have south half of lot lib Avenue B in the Oak ~rove Cemetery conveyed to Mm. D. P. Williams. <br />The Oity records show that M~. Piland purchased thms lot on October l?, 191~, ~a~.d that a deed <br />w~s drawnfor the same. I therefore ~ggest that I be ~uthorized to dr~wa~uplmcate deed to <br />N_r.
