The Board shall develop strategies and programs for <br />handling local responsible offenders. Mandated progra~ns <br />include community service, publicinebriate diversion, home <br />incarceration, electronic monitoring, probation supervision, <br />and substance abuse assessment;~testing and treatment. <br /> <br /> I, therefore, recommend that you adopt the attached <br />ordinance as submitted." <br /> <br /> Motion bY Mr. Clemons, and seconded by Mr. Robinett, to <br />adopt the following ordinance, and was adopted by 'the following <br />vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 2 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988) BY REPEALING SECTIONS 2-790 <br />THROUGH 2-793 AND BY ADDING A NEW SECTION 2-790 THERETO, <br />PERTAINING TO THE COMMUNITY CRIMINAL JUSTICE BOARD~" <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />95-283 Letter from the City Manager recommending adoption of <br />an ordinance to amend Chapter 24 of the City Code to provide <br />for collection of expenses~arising from Certain disorderly <br />businesses, and to allow the City to remove unsightly graffiti, <br />from walls, fences, etc. <br /> <br /> "The State legislature has provided the City of Portsmouth <br />the authority to collect monies expended due to emergency <br />response of the police department or medical services personnel <br />at sporting events, restaurants or other businesses or <br />commercial activity which draw large crowds, and who have <br />failed to provide adequate security and crowd control. <br /> <br /> In addition, State Legislation has also provided the City <br />the authority to remove or repair defacement of public and <br />private buildings and walls where such defacement is visible <br />from the public right-of-way. <br /> <br /> I, therefore, recommend adoption of this ordinance which <br />will enable the City to appropriately respond to these forms of <br />inappropriate conduct." <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988) BY ADDING SECTIONS 24-251 AND <br />24-325 THERETO, PERTAINING TO OFFENSES AND MISCELLANEOUS <br />PROVISIONS." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />95-284 - Letter from the City Manager recommending adoption of <br />an ordinance to amend Section 35-416 of the City Code to <br />broaden the definition of what constitutes a violation of the <br />City's code provision with reference to food taxes. <br /> <br /> "The State legislature has redefined what constitutes a <br />criminal violation with reference to food taxes. The statute <br />now provides that willful failure to pay, or a willful attempt <br />to evade the payment of food taxes and the reporting thereof, <br />constitutes a Class 1 misdemeanor. <br /> <br /> I, therefore, recommend adoption of the attached ordinance <br />which will bring the City's definition of what constitutes such <br />an offense into compliance with that authorized by the State <br />code." <br /> <br /> <br />
