the 203 July 25, 1995 Motion by Mr. Griffin, and seconded by Mr. Pitts, to adopt following ordinance and was adopted by the following vote: "AN ORDINANCE TO AMEND CHAPTER 24 OF THE CODE OF THE CITY VIRGINIA {1988) BY ADDING SECTIONS 24-260, 24-261 THERETO· PERTAINING TO LOITERING IN PUBLIC PLACES." Clemons, Griffin, Hawks· Martin, Pitts, Robinett, Webb None 1 - Letter from the Acting City Manager recommending of an ordinance to ~unend Section 35-13(a) of the City pertaining to taxation. "The City Treasurer has encountered some difficulties with business owners with regard to the interpretation of the "preceding tax year" in Section 35-13 of the City Code. section pertains to the issuance of a business license all delinquent personal property taxes and machinery and taxes have been paid. It is therefore desirable to ~te the phrase "preceding tax year" so as to clarify the of the code so that there is no misunderstanding that delinquent taxes are to be paid prior to the issuance of the 35 license. I hereby recommend your adoption of this code amendment." Motion by Mr. Hawks· and seconded by Mr. Pitts, to adopt ordinance, and was adopted by the following vote: "AN ORDINANCE TO AMEND CHAPTER 35 OF THE CODE OF THE CITY , VIRGINIA (1988) BY AMENDING SECTION 35-13(A) PERTAINING TO TAXATION." Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb None 2 - Letter from the Acting City Manager recommending of an ordinance to aanend Chapter 38 of the City Code by Section 38-40(a) (1), pertaining to water, sewers and disposal. ~ "Portsmouth's current charge for residential water service that the Department of Public Utilities will install tap into the main water line, install the water service · meter connection, the meter box and meter for a fixed fee 500. In some new developments, it is advantageous for the )er to install the tap, service line, meter connection and when they are installing the new water mains, streets In such cases, the current Code does not allow the loper to receive any credit against the current fixed fee of even though they have done work that the Public Utility would normally have to perform. The Director of Public Utilities has requested that City Section 38-40 (a) (1) be amended to allow developers who the tap, service line, meter connection and meter box be to pay a lower connection fee of $200. This lower fee recognize the work that they have performed. This t!rpe of fee when the developer does work is already in place in ,eake, Virginia Beach and Norfolk. I agree with the recommendation of the Director of Public ities and ask that you approve this Code amendment."
