<br /> At a Regular Meeting of the City Council on Tuesday, March 12, 2002,
<br />there were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts,
<br />P. Ward Robinett, Jr., J. Thomas Benn III, Charles B. Whitehurst, Sr., City Manager
<br />Daniel M. Stuck, City Attorney G. Timothy Oksman.

<br /> Adante Moore opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a
<br />Called Meeting on February 25, 2002, a Called Meeting on February 26, 2002, and a
<br />Regular Meeting on February 26, 2002, and was adopted by unanimous vote.

<br />02 - 71 - Presentations:

<br />· Proclamation presented to Lesha Sorrell for "Girl Scout Week".

<br />· Presentation of the proposed 2002/03 Operating Budget by the City Manager, Daniel
<br /> M. Stuck.

<br />
<br />01 - 342 - Public hearing on a use permit application:
<br />
<br />(d) UP-01-28
<br />
<br />DOWNTOWN NEIGHBORHOOD - Terrence Webb requests a use
<br />permit to operate a restaurant at 233 High Street. The
<br />Comprehensive Plan recommends commercial development of the
<br />area. Deferred from the January 8, 2002 City Council meeting.
<br />
<br />1. Mark Geduldig-Yatrosky, 363 Middle Street, spoke on the process and length of time
<br /> in processing an application.
<br />
<br />2. Eloise C. Hall, 111 High Street #302, spoke in opposition to this item.
<br />
<br />3. Reverend Daryl S. Adams, 442 Barlow Drive, spoke in support of this item.
<br />
<br />4. Terrence Webb, 3145 Gaston Drive, Chesapeake, spoke in support of this item.
<br />
<br /> Motion by Mr. Whitehurst, and seconded by
<br />recommendation of the Planning Commission that
<br />reading.
<br />
<br />Mr. Benn, to concur with the
<br />UP-01-28 be approved on first
<br />
<br /> Amended motion by Mr. Pitts, and seconded by Mr. Benn, that the conditions be
<br />amended to provide that all trash receptacles shall be removed from the public right-of-
<br />away not later than 8:00 a.m. of the day of pick-up and that the applicant is required to
<br />remove all trash spillage from his receptacles after pick-up, and was adopted by
<br />unanimous vote on first reading.

<br />
<br />DOWNTOWN NEIGHBORHOOD - Christina Fulp requests a use
<br />permit for an art gallery at 225 High Street. The Comprehensive
<br />Plan recommends commercial development of the area. Deferred
<br />from the January 8, 2002 City Council meeting.

<br />1. Dr. Jeanette Evans Copeland, 1362 Keaton Way, Chesapeake, spoke in support of
<br /> this item.
<br />
