<br />ENTITLED "AN A0T TO PROVIDE A NEW 0HARTER FOR THE CITY

<br /> section 24 Chapter lll of an act
<br /> mew charter for the City of Portsmouth,
<br />
<br /> Section. 24- ~here by the provisions of this act, or by the general laws of the State
<br />of Virginia, the City Oouncil has authority to pass ordinances or regulations on any subject,
<br />they may prescribe and impose suitable penalties for the violation of such ordinances or re-
<br />gulations or any of them, by fine not exceeding Five Hundred Dollars or hy imprisonment not
<br />exceeding twelve months, or both (~xcept where the penalty is in said charter otherwise pro-
<br />vised for) and may pro~ide that the offender, on failure to pay any fine imposed shall be
<br />imprisoned in the jail of said city for any term not exceeding six calendar months. Such fines
<br />may be prose~ted and recovered with costs in the name of the City of Portsmouth. The city
<br />may also maintain a suit to restrain by injunction the violation of any ordins~ce, notwith-
<br />standing such ordinance may provide punishment for its violation."

<br /> On motion of Nm. Stewart, the Act was adopted, and by the following vote:

<br />PROVED N~tRCH 13, 1912, AS AMENDED BY AN A0T APPROVED FEBRUARY 23, I9X8, XN REFERENCE TO THE
<br />ISSUE OF BONDS.
<br />
<br /> Be it enacted by the General Assembly of Virginia that section 32-~ of the charter of
<br />theOity of Portsmouth, approved March 13, 1912, as amended by an a~t approved February 23, -
<br />1918, in reference to the issue of bonds, ~be amended and re-enacted so as to read as follows:
<br />
<br /> Section 32-a. The city council of the city of Portsmouth shall have power and authority
<br />is hereby given to it, to is~s~e, from time to time, bonds, or other interest bearing obligations
<br />for the purpose of borrowing money to carry into effect the purposes and objects authorized
<br />by the charter of s~id city; to build sund eGuip school houses and for~other school purposes;
<br />provided, however, that no such bonds or other interest bearing obligations shall be issued
<br />except upon an ordinance passed by a recorded ~ffirmative vote of twa-thirds of all the members
<br />elected to the said council setting forth the purpose for which the said bonds or interest
<br />bearing obligations are to be issued, the length of time for which they are to be issued,
<br />which time shall not exceed thirty years, and the rate o~ interest, which shall' not exceed
<br />six per cemtumper annum; and provided, further, that the total amount of bonds issued, in
<br />the aggreg~.te, shall not exceed eighteen per centum of the assessed valuation of the real
<br />estate in the city subject to taxation as shown by the last preceding ~ssessmen~ ~6r'taxes;
<br />and provided further, that in determining the limitation of the power Of the city to incur
<br />indebtedness there shall not be included the following classes of ind~btedness~
<br />
<br /> (a) Oertificates ~f indebtedness, revenue bonds, or other obligations issued in antici-
<br />pation of the collection of the revenue of said city for the then surrent year; provided that
<br />such certificates, bonds or other obligations mature within one year from the date of their
<br />issue, and be not past due, and do not exceed the revenue for such year;
<br /> Section
<br /> (b) Bonds authorized by an ordinamce enacted in accordance with/One Hundred and Twenty-
<br />seven B of the Constitution of Virginia, and approved by.the affirmatiM~e vote of the majority
<br />of the qualified voters of said city voting uponthe Question of their issuance, at the general
<br />election next succeeding the enactment of the ordinance, or at a special election held for
<br />tha~urpose for a supp%y of water o~ other specifid undertaking from which the city m~y derive
<br />a revenue; but from ane after a permod to b~ determined by the council, not exceeding five
<br />years from the d~te of such election, whenever and for so long as such undertaking fails to
<br />pro~uoe revenue to pay for cost of operation and administration (including intemest on bonds
<br />issued therefor, and the cost of insurance against loss by injury to persons or property), ~
<br />and an annual amount to be covered into a sinking fund sufficient to pay~ mt or beforemm~Urmty,
<br />all bonds issued on account of said undertaking, all such bonds outstandmng shall be'included
<br />in determining the limitation of the power to incur indebtedness, unless the ~rincipal ~ud
<br />interest the=eof be made payable exclusively from the receipts of the undertaking."
<br />
<br />On motion of Mr. Oast, the Act was adopted, and by the following vote:
<br />

<br /> AN AOT TO ~ND AND RE-ENACT SECTION ~60~ AN ACT ENTITLED, "AN ACT TO PROVIDE A NEW
<br />OHARTER FOR THECITY OF PORTSMOUTH, APPFO~YED ~ARCH 10, 1908, RELATING TO SALARIES OF OFFIOERS
<br />OF SAID CITY.
<br />
<br /> Be it enacted by the General Assembly of Virginia, that section 76 of an act entitled
<br />an act ~o provide anew chamter for the City of Portsmouth, approved March lO, t90~, be am~ud-
<br />ed and re,enacted so as to read as-follows:
<br />
<br /> Section ~6: With the exception of members of the City Council whose ss~aries shall be
<br />fixed by the charter of the city, the City Council shall grant and pay to s~l officers of the
<br />City of Portsmouth and to their clerks and assistants, elected or appointed in pursuance of
<br />the city charter, or the laws of the State of Virginia, or the ordinances of the City, such
<br />salaries or compensation as shall be'fixed by ordinance, and may provide that such salaries
<br />shall be in full compensation of the services performed TOm the city, and in lieu of fees
<br />allowed for services rendered the city."

<br />On motion of Er. Stewart, the Act was adopted, and by the following vote:
