<br /> In the Portsmouth Star of June 12th, the City Attorney was quoted as stating to
<br />the Council that the property holders along Scott's 0reek had signed a petition signifying
<br />th~i~willingness for the Oity to construct~a bridge without draw, across said creek.
<br />
<br /> The undersigned owners of practically s~ll the property, except about one hundred
<br />feet, along the East bank of Scott,s creek from Leckie street to the Southern end of same;
<br />wish to go on record as having refused, both Mr. Shea and his attorney, Mr. 0aesell; to
<br />sign said petition.
<br />
<br /> Ou~ reasons for net signing were two-fold end were plainly stated to Mr. Oassell.
<br />First, we know that building a bridge across the creek at Leckie St. would m~terially de-
<br />crease the value of our water £ront property, particularly a bridge without a d~raw. Second,
<br />we do not think the tax payers of the Oity at large, should, under present conditions, be
<br />burdened with the cost ~f a bridge that will only be of service to a very few.

<br /> In reference to the bills of ~. H. W. Oassell ~nd Jason I. Eckford in the sums
<br />of $250. for examining the office of the Clerk of the Court of Hustings, and $100. for examin-
<br />ing the office, of the ~terk cf the Circuit Court, section 3383 of the Code of Virginia, (1919),
<br />pro~ides as follows:

<br /> "Before any vacancy existing or to oc~ in the office of a O!erk shall be
<br />filled, the court, or the judge thereof in vacation, shall, and at ~hy other tLme may, appoint
<br />twoor more persons to examine the Clerk, s office. They shall examine the office books,_and
<br />the condition of the records and papers in the office, and report whether the clerk has faith-
<br />fully disch?rged his duties. The court maY allow each person making such examination not
<br />exceeding fzve dolta~vs per day, which, if the examination be of the clerk's office of the
<br />-circuit tours of a county, or the circuit, corporation of a city, shall be chargeable on such
<br /> county or city, etc.,

<br /> I find ~hat Messrs. 0assell and Eckford were appointed by the 0curt of Hustings
<br />to examine the Clerk s office of that court, on Anril 10, 1929, and they reported on June
<br />2~, 1929. TheF were appointed by the Circuit Oc'~rt to examine the office of that court, ~
<br />on April 11, 1~29~ and reported June 2~, 1929. The bill of $250. has been approved by She
<br />~ud~.of the Hustings Octet, and the one of $t00 has been approved by the Clerk of the 0ircuit
<br />
<br /> On account of the vacancy in the two offices occasioned by the death of Mr. E.
<br />Thompson the above section 33~3 of the Code made it necessary for the judges to appoint some-
<br />one to examine the offices, and the City is required to pay the bills, which s.re limited to
<br />$5.00 per day. No provision is made as to who shall certify the bill.
