That the use for which the permit hereinafter- <br />described is sought: <br /> <br /> (a) <br />persons <br />use; <br /> <br /> Will not adversely affect the health and safety of <br />residing or working in the neighborhood of the proposed <br /> <br /> (b) Will not be detrimental to the public use <br />or injurious to the property or improvements in the <br />nexghborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to <br />· nsure compatibility with surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to <br />a plan for parking, driveways, and curb cuts which will provide <br />for safe and convenient traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City <br />of Portsmouth Zoning Ordinance. <br /> <br /> 2. That Delbert B. Glenn is hereby granted a use permit <br />pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) for the operation of an adult <br />residential care facility on property located at 104 Utah <br />Street, and being more particularly described as: <br /> <br />UP-95-16 <br /> <br /> Beginning at a point on the southeastern corner of the <br />intersection of Utah Street and Kingman Avenue, thence in a <br />southeasterly direction along the southern right of way on <br />Kin~N~an Avenue 131 feet(+/-) to a point, thence in a southerly <br /> <br />direction 78 feet(+/-) <br />direction 69 feet(+/-) <br />direction 67 feet(+/-) <br />direction 280 feet(+/-) <br />direction 150 feet(+/-) <br />southeastern corner of <br />Kingman Avenue. <br /> <br />to a point, thence in an easterly <br />to a point, thence in a southerly <br />to a point, thence in southwesterly <br /> to a point, thence in a northerly <br /> to the beginning point on the <br />the intersection of Utah Street and <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />{a) Occupancy of the facility shall be limited to <br />(17) residents, aged fifty-five (55) or older, and <br />staff members. <br /> <br />seventeen <br />to required <br /> <br />(b) The facility shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments, and shall obtain and maintain in effect all <br />necessary licenses and permits. <br /> <br />(c) The project shall be developed in accordance with <br />submitted site and floor plans as approved by the City. <br /> <br />(d) Prior to occupancy and at least annually thereafter, the <br />facility shall request an inspection by the Fire Prevention <br />Bureau, the Public Health Department and the Building Official <br />and shall correct any noted deficiencies. <br /> <br />(~) The applicant shall install six-foot high privacy fencing <br />around the perimeter of the property to buffer the residential <br />structures on Kinqman Avenue and shall install and maintain a <br />Group I landscaping between the required parking lot and the <br />adjacent house on Kingman Avenue. <br /> <br /> <br />
